In The BAP, DKI Kadinkes Cannot Confirm An Increase In Positive Cases Due To The Birthday Of The Prophet Petamburan

JAKARTA - Head of DKI Jakarta Health Service Widyastuti cannot confirm an increase in the number of positive COVID-19 patients in Petamburan Village because he has a history of participating in the Prophet's birthday on November 14, 2020.

Widyastuti's Kadinkes statement was contained in the examination report (BAPI) which was read again by Rizieq Shihab during the trial of cases of suspected crowds and violations of health protocols in Petamburan.

Initially, Rizieq, who was given the opportunity to ask, mentioned the comparison of the number of positive cases of COVID-19 during the two weeks before and after the Prophet's birthday.

Before November 14, 2020 there were 33 positive cases recorded. Then after November 14, 2020 it increased to 83 cases.

"Do you have data, can you confirm that the increase is due to the Maulid event? Can you be sure?" asked Rizieq during a trial at the East Jakarta District Court, Monday, April 26.

"The data we get is based on positive data reported by 67 laboratories in Jakarta," said Widyastuti

At that time, Rizieq read out the witness's investigation report. In point number 14 contains, the DKI Jakarta Health Office does not have data about the history of COVID-19 patients who participated or did not participate in the Prophet's Birthday event on November 14, 2020.

"Whereas the DKI Jakarta Health Service only has COVID-19 data starting from the patient's identity (NIK, name, place of birth date, address, cell phone number) of the reporting health facility (the first place the patient is treated), a swab taking certificate, and a PCR examination laboratory, and positive date, "said Rizieq reading the BAP.

"So that the DKI Jakarta Health Service does not have and cannot confirm the existence of a history referred to in a positive case of COVID-19 in DKI Jakarta Province with a history of having participated in an activity on November 14 in Petamburan," continued Rizieq.

Then, Rizieq confirmed the contents of the BAP. In fact, he questioned whether the BAP would be changed or not by Widyastuti at the trial.

"This answer is correct, ma'am?" asked Rizieq.

"That's right," answered Widyastuti

"Still maintaining this (BAP)?" asked Rizieq again.

"That's right," answered Widyastuti.

In the alleged violation of the health protocol in Petamburan, Rizieq Shihab was charged with incitement to the appearance of a crowd at his daughter's wedding as well as commemorating the Prophet's birthday in Petamburan, Central Jakarta. This crowd is taking place in the midst of the COVID-19 Pandemic.

Rizieq was charged with violating Article 160 of the Criminal Code in conjunction with Article 93 of Law Number 6 of 2018 concerning Health Quarantine in conjunction with Article 55 paragraph 1 to 1 of the Criminal Code and or Article 82 paragraph 1 in conjunction with Article 59 paragraph 3 letters c and d Law Number 16 of 2017 concerning Community Organization jo Article 55 paragraph 1 to 1 KUHP in conjunction with Article 10 letter b KUHP in conjunction with Article 35 paragraph 1 KUHP.
