Overlapping Rules For Online Motorcycle Taxi Problems For Passenger Transportation During The PSBB

JAKARTA - The DKI Provincial Government has imposed Large-Scale Social Restrictions (PSBB) for two weeks. One of the restrictions is prohibiting online motorcycle taxis from carrying passengers during the COVID-19 Pandemic in the Jakarta area.

On the other hand, the Ministry of Transportation (Kemenhub) issued regulations for controlling transportation during the COVID-19 epidemic. In this regulation, it allows private motorbike drivers and online motorcycle taxis to carry passengers, on condition that they must follow health protocols.

"Permenhub is made based on the real conditions today. So when this regulation is made with the current conditions. The government should pay attention to the dynamics developing, evaluate from time to time," said Kemenhub spokesperson Adita Irawati in a video conference, Sunday, April 12.

Minister of Transportation Regulation (Permen) Number 18 of 2020 concerning Transportation Control to prevent the Spread of Corona or COVID-19. The regulation was enacted on April 9, 2020 by the Minister of Transportation Ad Interim Luhut Binsar Pandjaitan.

According to Adita, the vehicle arrangement during the Corona pandemic was very dynamic. Covers transportation control for the entire region; transportation control in areas designated as Large-Scale Social Restrictions (PSBB) and transportation control for homecoming activities in 2020.

"What is regulated is related to transportation before the trip, on the way to the destination. It applies to all subsectors, sea, land, air and railways," said Adita.

In some of these regulations, it seems that there is not much difference with Permenkes 9/2020 concerning the provisions for implementing PSBB and Pergub number 33 of 2020 concerning the implementation of PSBB in handling COVID-19, as well as traffic rules from the police.

However, Article 11 paragraph 1 of the Permenhub states that application-based motorbikes are allowed to carry passengers. Whereas in the two previous regulations related to PSBB, this is clearly prohibited.

To be able to transport passengers, online motorcycle taxi drivers must follow the health protocol that was in effect during the PSBB. "Motorbikes for activities (transportation) in accordance with the PSBB must of course use masks, gloves, and disinfect vehicles and equipment before and after delivery," explained Adita.

In addition, online drivers are asked not to drive if they are sick or if their body temperature is above normal. "Passengers must not be unwell or temperature conditions are not normal. This is what is regulated in the Minister of Transportation," said Aditia.

For your information, the Pergub PSBB announced by the Governor of DKI Jakarta Anies Baswedan that online motorcycle taxis are no longer allowed to carry passengers. This is related to the imposition of transportation restrictions during the COVID-19 emergency response period.

"As for two-wheeled vehicles as a delivery service, yesterday an online motorcycle taxi was conveyed we will facilitate it to be able to transport people and goods, yesterday in talks with the Ministry of Transportation, we have the view to be allowed," explained Anies.

Likewise, Dirlantas Polda Metro Jaya, Kombes Sambodo Purnomo, private motorbike riders and online motorcycle taxis are not allowed to ride together during the PSBB. The police will also provide sanctions according to the Health Quarantine Law and the Criminal Code for motorists who violate it.
