Proposed Detention After Sentence, Maqdir Ismail Guarantees Suspect Will Not Escape

JAKARTA - Lawyer Maqdir Ismail denied that his proposal regarding detention was not carried out before the court's decision in the revision of the Criminal Procedure Code provided room for the suspect or defendant to run away or run away. According to him, lawbreakers cannot just run away.

"Look, what kind of person will run away like? Not many people can run away. Because of the real thing, the person to run away, if he wants to run away abroad, first he has to have a passport. He must have money. And he also has to have a connection. Because when he lives abroad, he can't just stay for more than three months in one country, right? You can't, he has to go home, or go to another country," said Maqdir at the Parliament Complex, Senayan, Jakarta, Wednesday, March 5.

According to him, the suspect's concern would run away because the court was not previously detained was too much.

"So it should be, in my opinion, that detention must really have an element or objective reason that shows that this person will indeed commit another crime or he will run away. Without that, detention should not be carried out," he said.

Maqdir assessed that a person suspected should also be given the opportunity to breathe free air before the court's verdict is knocked. He said no one wanted to commit repeated crimes even though the person concerned had many networks.

In fact, if a person is a public figure, then the authorities can easily monitor it.

"I think this is the case. We have to believe that these people will not, no one wants to commit repeated crimes. Where will anyone commit repeated crimes. In that way, when there are figures like that, because they are easy to see, it's easy for us to know. Is it true that they will obstruct the investigation? Not necessarily," said PDIP Secretary General Hasto Kristiyanto's attorney.

"It will be discovered once, for example, I will immediately meet someone, they will definitely be found out. So don't worry that people, if for example political figures are released from detention, they will commit new crimes. Don't worry like that," continued Maqdir.

"Let us believe that all citizens of this country have good intentions. Everyone wants legal certainty. Everyone wants to enforce the law fairly for the truth," he said.
