KPK Immediately Executes SYL After Cassation Is Rejected By The Supreme Court

JAKARTA - The Corruption Eradication Commission (KPK) immediately executed former Agriculture Minister Syahrul Yasin Limpo (SYL) after the Supreme Court (MA) rejected an appeal regarding the 12-year prison sentence in a corruption case within the Ministry of Agriculture in 2020-2023.

"With this decision, the case has been inkracht or has permanent legal force, so that the person concerned will then serve the corporal punishment and payment of replacement money as additional punishment according to the judge's decision, unless there are extraordinary legal remedies such as a review," said KPK spokesman Tessa Mahardhika in her statement.

Tessa stated that the KPK appreciated the verdict of the panel of judges in the cassation with the defendant SYL.

The KPK also expressed its appreciation to those who have provided data and information support so that the handling of this case can be carried out effectively.

In addition to providing a deterrent effect, the penalty for paying replacement money is also an instrument in increasing the recovery of state assets.

In this case, extortion in office is one of the focuses of preventing corruption carried out by the KPK in the management area of the state civil apparatus.

The KPK hopes that improvement steps can be taken immediately so that similar corruption crimes do not happen again.

The Supreme Court decided to reject the appeal of former Agriculture Minister Syahrul Yasin Limpo in a corruption case within the Ministry of Agriculture in 2020-2023, so that his sentence remains 12 years in prison as stated in the appeal decision.

Although rejecting SYL's appeal, the cassation panel decided to make improvements related to the editorial of the replacement money penalty so that it becomes more complete:

"Punishing the defendant to pay compensation of Rp44,269,777,204.00 plus 30,000 US dollars, is reduced by the amount of money confiscated in this case which was subsequently declared confiscated for the state, a subsidiary of 5 years in prison."

The cassation decision was decided on Friday by Supreme Court Justice Yohanes Priyana as chairman of the assembly accompanied by two members, Arizon Mega Jaya and Noor Edi Yono, and Setia Sri Mariana as substitute clerks.

"The case has been decided, it is in the process of being mitigated by the panel," said the statement of the status of the case.

At the appeal level, the Jakarta High Court increased the sentence of SYL to 12 years in prison, a fine of Rp. 500 million, subsidiary to four months in prison, and compensation of Rp. 44,269,777,204 plus US$30,000, subsidiary to 5 years in prison.

Previously, the panel of judges at the Corruption Court at the Central Jakarta District Court sentenced SYL to 10 years in prison, a fine of Rp. 300 million, subsidiary to four months in prison, and compensation of Rp. 14.14 billion plus US$30,000, subsidiary to 2 years in prison.

The first-degree court decision is lighter than the demands of the KPK public prosecutor, namely a 12-year prison sentence, a fine of Rp. 500 million, subsidiary to 6 months imprisonment, and compensation of Rp. 44.27 billion and US$30,000 minus the amount of money that has been confiscated and confiscated.

In this case, SYL was charged with extortion or receiving gratuities with a total of IDR 44.5 billion within the Ministry of Agriculture in the range from 2020 to 2023.

The extortion was carried out with the Secretary General of the Ministry of Agriculture for the period 2021'2023 Kasdi Subagyono and the Director of Agricultural Equipment and Machinery at the Ministry of Agriculture in 2023 Muhammad Hatta. Both are coordinators of the collection of money from echelon I officials and their staff to pay for personal needs and SYL's family.
