Commission II Of The DPR Asks DKPP To Check KPU-Bawaslu In The Aftermath Of The Constitutional Court For Disqualification Of Regional Head Candidates

JAKARTA - Member of Commission II of the Indonesian House of Representatives, Indrajaya, highlighted the final decision of the PHPU in the Constitutional Court which ordered re-voting (PSU) in a number of regions. The PSU order was due to the disqualification of the regional head candidate due to the invalidity of the candidacy status.

Among them, the disqualification of Candidates for Deputy Regent of Pasaman West Sumatra, Candidates for Deputy Regent of Tasikmalaya, Candidates for Deputy Governor of Papua, and in particular against Candidates for Regent of Boven Digoel, South Papua. In the aftermath of the disqualification of the candidate for regional head, Indrajaya asked the DKPP to examine the KPU and Bawaslu.

"This is purely due to the negligence of the KPU and Bawaslu. DKPP must process, make this information a report, and try it," Indrajaya told reporters, Tuesday, February 25.

"The Constitutional Court's decision is very worrying, the nomination administration examination should have been completed at the time of registration at the KPU," he continued.

Indra said similar incidents are always repeated in every election. Referring to the principles of the code of ethics for election organizers, intentional or unintentional, according to him, KPU and Bawaslu must be held accountable.

"If it is intentional, it is clearly a violation of the law, if it is not intentional, the category is unprofessional, not careful or careless. So, both of them must be given strict sanctions," said the PKB politician.

The legislator from the South Papua electoral district then gave an example of the Constitutional Court's Decision for PSU in Boven Digoel Regency without including Candidates for Regent Petrus Ricolombus Omba who was disqualified even though he was declared victorious by KPU Boven Digoel.

"The status of regent candidate Petrus Ricokumbus Omba as a former convict at the Military Court can be known from the registration. This is strange, there is a impression that it is covered up, and there is an impression that he does not consult if he does not understand, this is inappropriate," said Indra.

Not only regarding candidate pairs, Indra assessed, it must also be considered by the people who are already supporters. Supposedly, he said, election organizers should be more sensitive to the consequences.

Indra also hopes that the people of South Papua can accept the Constitutional Court's decision even though they are disappointed. "It's time to unite to build this new autonomous region more advanced, colored by brotherhood," said Indra.

Indra also reminded that the Constitutional Court's decision is final and binding (finals and bindings). Alias, there are no other efforts after the PHPU decision.

"This is clearly the negligence of the KPU and Bawaslu at the district, city and provincial levels, so we hope that the organizers above can report to the DKPP. Do not let a similar incident continue to repeat itself, onlyILs that repeatedly fall into the same hole," concluded Indra.

It is known that nine Constitutional Justices have finished reading the verdict of 40 cases of Dispute over the 2024 Regional Head Election Results (PHPU Kada) which were examined further in the plenary session which was held on Monday, February 24.

Overall of these 40 cases, the Constitutional Court (MK) granted 26 cases, rejected 9 (nine) cases, and did not receive as many as 5 (five) cases. With the trial of Disclosure of this Decision, it indicates that the Constitutional Court has finished handling the 2024 Kada PHPU case, which amounts to 310 applications.

Regarding all the decisions granted, there were 24 cases whose verdict ordered the General Election Commission (KPU) in their respective regions that were questioned to re-vote (PSU).

In addition, in one decision the Constitutional Court instructed the KPU to recapitulate the results of the vote, namely in Case Number 305/PHPU.BUP-XXIII/2025 related to PHPU Kada Kab. Puncak Jaya.

Then in Case Number 274/PHPU.BUP-XXIII/2025 related to PHPU Kada Jayapura, the Court ordered an improvement in the writing of the Jayapura Regency KPU Decree concerning the Determination of the Results of the 2024 Jayapura Regent and Deputy Regent Election.
