Today, The Constitutional Court Reads The Decision Of 40 Cases Of Dispute In The 2024 Regional Head Elections

JAKARTA - The Constitutional Court (MK) on Monday (24/2/2025) will read out the verdict of 40 cases of dispute over the results of the 2024 regional head election (PHPU Kada). The trial for reading the 2024 Pilkada dispute decision began at 08.00 WIB in the Gedung I Court courtroom and was chaired directly by the Chief Justice of the Constitutional Court, Suhartoyo, along with eight other constitutional judges.

Previously, out of a total of 310 cases of dispute over the 2024 Pilkada which were registered, 270 cases had died during the initial examination which was decided in the interim trial on February 4 and 5, 2025. In detail, 227 cases were declared unacceptable, 29 cases were withdrawn, eight cases were declared dead, and six cases were declared not under the authority of the Constitutional Court.

Meanwhile, 40 cases of election disputes in 2024 that passed the initial examination then continued to the evidentiary trial. The details are three cases related to the election of governors and deputy governors (pilgub), three cases related to the election of mayors and deputy mayors (pilwalkot), and 34 cases related to the election of regents and deputy regents (pilbup).

This trial of evidence includes examination of witnesses, experts, and additional evidence, and has been going on from 7 to 17 February 2025. The examination trial of 40 cases was divided into three panel of judges, with the composition of Panel I led by Suhartoyo, together with Daniel Yusmic Foekh and M Guntur Hamzah (checking 15 cases).

Furthermore, Panel II, led by Saldi Isra, together with Ridwan Mansyur and Arsul Sani (checked 13 cases). Then, Panel III led by Arief Hidayat, together with Anwar Usman and Enny Nurbaningsih (checked 12 cases).

During the trial, the Constitutional Court gave each party the opportunity to present witnesses and/or experts, with the maximum provision of six witnesses/experts for the gubernatorial election, and a maximum of four witnesses/experts for pilwalkots or pilbup. In addition, other parties who are considered to have links to the case are also summoned to provide information.

Based on Law and Constitutional Court Regulation Number 1 of 2025, the Constitutional Court is required to resolve the entire 2024 Pilkada dispute within a maximum of 45 days from the time the case is registered.
