Five Defendants Of Optical Cable Thief In Sutomo Medan Freed By Judges, Will Be Released From Prisoners

The panel of judges at the Medan District Court (PN), North Sumatra, sentenced five defendants to the theft of an optical cable support pole located on Jalan Sutomo, Medan City.

"Declaring that the defendants are not proven to have committed the crime of theft as the first and second alternative charges of the public prosecutor," said Chief Judge Joko Widodo at the Medan District Court, Thursday, February 6, as reported by ANTARA.

The panel of judges said the five defendants, namely Dedi Saputra (43), Andria Gandi (39), Dedi Ramianto (47), Dana Pratama (41) and Toto Rusman Hadi (42).

In its decision, the panel of judges also ordered the Public Prosecutor (JPU) of the Medan Kejari to release the defendants from detention.

"Recovering the rights and good names of the defendants, including dignity and dignity," explained Judge Joko.

According to the judge based on the facts at trial, the five defendants were not found guilty of violating Article 363 paragraph (1) of the 4.5 of the Criminal Code, according to the primary indictment.

"The defendants were also not proven guilty of violating Article 363 paragraph (1) 4.5 in conjunction with Article 53 paragraph (1) of the Criminal Code, as stated by the subsidiary indictment," said Judge Joko.

After reading the verdict, Chief Judge Joko Widodo gave seven days to the Public Prosecutor's Office of Medan Evi Yanti Panggabean to state his position to appeal the acquittal.

The Public Prosecutor's Office of Medan, Evi Yanti, previously charged the five defendants with three years and six months in prison each.

"The five defendants were proven to have violated Article 363 paragraph (1) 4.5 in conjunction with Article 53 paragraph (1) of the Criminal Code," he said.

Public Prosecutor Evi in the indictment said that the five defendants had stolen an internet pole or an optical cable support pole on Jalan Sutomo, precisely at the intersection of Jalan Gandi, Medan Kota District, Medan City on October 17, 2024 in the early hours of the morning.

"However, the actions of the five defendants were known by police officers from the Medan Polrestabes who were on patrol at that time," he said.

Then, he continued, police officers arrested the five defendants and secured evidence in the form of optical cable support poles.

"As a result of the actions of the five defendants, PT Mora Telematika Indonesia Tbk suffered a loss of approximately Rp. 10 million," said Public Prosecutor Evi.
