Kohod Village Residents Admit Not Empowered When KTP Is Borrowed For SHM And SHGB: The Developer Is Agung Sedayu Group

TANGERANG, a resident of Kohod Village, Pakuhaji District, Tangerang Regency, admitted that he experienced intimidation while trying to defend their land from developers affiliated with the Agung Sedayu Group (ASG).

Haerudin, a resident of Kohod Village, revealed that the Building Use Rights Certificate (SHGB) and Certificate of Ownership (SHM) on land in the area are now recognized by two companies, namely PT Intan Agung Makmur and PT Cahaya Inti Sentosa. However, these two companies are known to be affiliated with ASG.

(Development) Agung Sedayu Group. But they use third parties to free this land. Agung Sedayu's big name is only used as an identity, but they are still behind him," said Haerudin when met in Tanjung Burung, Kohod Village, Pakuhaji, Tangerang Regency, Tuesday, January 28.

Haerudin added that ASG's involvement in this case was used to put pressure on residents to give up their land. Residents feel powerless to deal with the intimidation.

"This is actually a sea fence, but we are intimidated. If we protest, a letter from the Resort Police will come. It is said that we stand on the banks of the river illegally. Even though it is our land, it has been certified," he said.

He also accused the existence of criminalization against residents who tried to fight back. Our society has even been intimidated by criminalizing it. If we fight, we are immediately threatened with legal action," he added.

Haerudin hopes that the government will not only cancel problematic certificates, but also thoroughly investigate the parties involved to ensure similar incidents do not happen again.

"I hope it will not only be canceled, but also take firm action. Investigate all the individuals involved," he said.

This case began when the Identity Card (KTP) belonging to a number of Kohod Village residents was borrowed by village staff, allegedly on the orders of the Kohod Village Head. The residents did not know the purpose of the loan, until recently they found their land was certified by SHM without their knowledge.

Based on data from the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN), there are 263 plots of land in the area that are already in the form of SHGB. The details are: - 234 plots in the name of PT Intan Agung Makmur, - 20 plots in the name of PT Cahaya Inti Sentosa, - 9 plots in the name of individuals.

In addition, there are also 17 plots of land with the status of SHM issued in the sea fence area.

The Ministry of ATR/BPN has confirmed the existence of a certificate in the sea fence area. Based on the BHUMI ATR/BPN application, the location of this certified land is in Kohod Village, Pakuhaji, Tangerang Regency.

The Ministry of ATR/BPN promised to take firm action against parties involved in issuing certificates that violate legal regulations.
