Proven Corruption Of House DP Rp0, Former Director Of PPSJ Yoory Corneles Sentenced To 5 Years In Prison

The trial for reading the verdict of the panel of judges related to the corruption case of the Rp0 DP House program attended by defendant Yoory Corneles, online/ANTARA/Agatha Olivia Victoria.

JAKARTA - Former President Director (Managing Director) of Perumda Pembangunan Sarana Jaya (PPSJ) Yoory Corneles was sentenced to five years in prison in connection with the corruption case in land acquisition in Pulo Gebang, East Jakarta for a down payment (DP) program of IDR 0 of the DKI Jakarta Provincial Government.

"Declaring that the defendant Yoory Corneles has been legally and convincingly proven guilty of committing a criminal act of corruption together as in the first indictment of the public prosecutor," said Chief Judge Bambang Joko Winarno in a trial reading the verdict of the panel of judges at the Jakarta Corruption Court (Tipikor), Monday, January 20, reported by ANTARA.

In addition to imprisonment, the Panel of Judges also imposed a fine of Rp. 300 million, provided that if the fine was not paid, it would be replaced (subsidiary) with imprisonment for three months.

The Panel of Judges also imposed an additional penalty in the form of payment of replacement money amounting to Rp1.74 billion. If within one month after the verdict has legal force, the convict is still not paying the replacement money, his property will be confiscated by the prosecutor and auctioned off to cover the replacement money.

"In the event that the convict does not have sufficient assets to pay the replacement money, he will be sentenced to imprisonment for one year and six months," said the presiding judge.

The presiding judge said Yoory was proven to have violated Article 2 Paragraph (1) in conjunction with Article 18 Paragraph (1) letter B of Law (UU) Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 Jo. Article 55 Paragraph (1) 1st of the Criminal Code.

In deciding Yoory, there were several aggravating and mitigating things that were considered by the Panel of Judges. The aggravating thing is that Yoory's actions do not help the government's program which is actively eradicating corruption and can hinder housing development projects, especially for low-income people.

Meanwhile, the mitigating factors considered, said the Chief Justice, namely Yoory being polite and honest in the trial, having returned the money received from the defendant Tommy Adrian, and is currently serving two sentences, namely in the first case being sentenced to six years and six months, while in the second case he was sentenced to four years.

"The assembly is of the opinion that the punishment or punishment imposed on the defendant if it can fulfill the sense of justice for the defendant and the community," said the presiding judge.

The verdict is almost the same as the demands given by the public prosecutor (JPU) to Yoory. Previously, Yoory was sentenced to five years in prison in connection with the case.

For the criminal fine, the Public Prosecutor demanded Yoory with a fine of Rp. 300 million, but with a subsidiary higher than the verdict, namely imprisonment for six months in prison.

Likewise with the additional sentence, the Public Prosecutor previously charged Yoory with a larger replacement amount, namely Rp31.17 billion, subsidiary to imprisonment for three years.

In that case, Yoory was charged with joint corruption or abuse of authority, resulting in a total loss of state finances of Rp256.03 billion.

Yoory is suspected of committing corruption together with the owner of the benefits of PT Adonara Propertindo, Rudy Hartono and Operations Director of PT Adonara Propertindo Tommy Adrian.

For his actions, Yoory was charged with enriching himself by Rp31.82 billion, while Rudy enriched himself worth Rp224.21 billion, causing losses to state finances.
