Allegedly Fake SK Regent Of East Halmahera, Harum Energy Subsidiary Reported To Bareskrim Polri

JAKARTA - The nickel mining company was reported in connection with the alleged forgery of the Decree (SK) of the East Halmahera Regent to the Criminal Investigation Unit of the Police.

It is known that the company reported was a subsidiary of PT Harum Energy Tbk, PT Position.

"Lossessing our client PT WHBP. Due to the falsification of the Regent's Decree, PT WHBP cannot be included in the MODI (Minerba One Data Indonesia, ed), mining database at the Ministry of Energy and Mineral Resources, because it seems as if there is an overlap. Even though if according to the original Regent's Decree, which is 8 coordinate points, there is actually no problem," said PT WHBP's attorney, M. Mahfuz Abdullah, quoted Wednesday, October 23.

In the report, the Decree of the Regent of East Halmahera which was allegedly falsified was with Number: 188.45/540-05/2010 dated January 11, 2010. The decree concerns the area of PT Position's Mining Business Permit (IUP).

According to Mahfuz, the allegedly fake decree caused the PT Position IUP region to overlap with the PT WHBP IUP area which is also engaged in nickel mining.

Referring to the original SK of the Regent of East Halmahera, the area of the IUP PT Position is 4,047 hectares with 8 coordinates.

However, the documents submitted to the Ministry of Energy and Mineral Resources for the completeness of the MODI requirements changed to 68 coordinate points.

Meanwhile, the production operation mining business permit (IUP OP) area of PT WHBP which is based on the Decree of the Governor of North Maluku Number: 502/2/DPMPTSP/IUP-OP.LB/X/2020 dated 27 October 2020, PT Wana Halmahera Barat Permai with an area of 1,053.55 hectares.

The former regent of East Halmahera, Mr. Wehelmus Tahalele, the person whose signature was stated in the decree, emphasized that he had never made a letter with a total of 68 coordinate points. The truth is only 8 coordinate points," he said.

"This affirmation was also made by him in the form of a statement passed by the Notary on July 18, 2017. He also stated that he was ready to be summoned to provide information. This was confirmed by him in the report on the results of the examination by the Indonesian Ombudsman," continued Mahfuz.

The addition of coordinates in the East Halmahera Regent's Decree makes the PT WHPB IUP area seem to be within the IUP Position area.

"As a result, until now PT WHBP has never received registration at MODI (Minerba One Data Indonesia, ed) Ministry of EDSM. In fact, before the addition of 60 coordinate points, PT WHBP had received a Clear and Clean or CnC Phase 6 certificate from ESDM in 2012. Meanwhile, PT Position received CnC phase 9 in 2013," he said.

It is said that the alleged forgery has actually been used as material for public complaints in May 2024. The investigator's conclusion must be made a Model B Police Report.

"Well, today we fulfill that, accompanied by a number of evidences," said Mahfuz.

Meanwhile, the police report was received with registration of LP/B/379/X/2024/SPKT/BARESKRIM POLRI dated October 22, 2024.

In the report, the reported party is suspected of violating Article 263 of the Criminal Code and/or Article 266 of the Criminal Code concerning the Crime of Counterfeiting Letters and/or Placing False Information in the Authentication Deed.
