Civil servant investigators from the Regional Office of the Directorate General of Taxes, Nusa Tenggara (DJP Nusra) handed over a suspect in a tax evader who works as a businessman from Sekongkang with the initials ZA along with evidence to the public prosecutor of the West Sumbawa District Attorney, West Nusa Tenggara.

Head of the Regional Office of DJP Nusra Samingun said that civil servant investigators (PPNS) handed over the suspect and evidence after the research prosecutor stated that the case file was complete or P-21.

"So, this submission is stage two of the follow-up files declared complete by the research prosecutor," said Samingun in his statement in Mataram, Friday, September 20.

ZA's crime in this case was related to non-compliance in depositing a value added tax (VAT) resulting in state financial losses of Rp595 million.

The act that caused state financial losses lasted during the tax period from January to December 2018 when PT SBS became PT Amman Mineral's partner.

Although PT Amman Mineral has made payments for 41 tax invoices, including 10 percent VAT, PT SBS has never made the proper VAT deposit.

"This causes the annual PPN period notification letter (SPT) to show zero value," he said.

He added that the Sumbawa Besar Pratama Tax Service Office (KPP) had made various efforts to collect debts of taxes, including sending a Letter of Request for Explanation of Data and Information (SP2DK) in 2019.

However, ZA never attended the counseling invitation until finally the Nusra DGT Regional Office took steps to investigate the case.

Samingun said that as an effort to compensate for state financial losses, his party had confiscated ZA's assets. This confiscation was carried out based on a Letter of Determination of Confiscation Permit from the Sumbawa Besar District Court which includes property worth Rp. 501,300,000.

"The legal process refers to the provisions of Article 39 paragraph (1) letter i of Law Number 6 of 1983 concerning General Provisions and Tax Procedures," he said.
