DKI High Court Increases SYL's Sentence From 10 To 12 Years In Prison

JAKARTA - The DKI Jakarta High Court (PT) has posted the former Minister of Agriculture (Mentan) Syahrul Yasin Limpo or SYL in cases of extortion and gratification within the Ministry of Agriculture (Kementan) of the Republic of Indonesia with a prison sentence of 12 years.

The verdict was heavier than the sanctions imposed on SYL in the first instance court.

"The defendant Syahrul Yasin Limpo was therefore sentenced to 12 years in prison and a fine of Rp. 500 million provided that if the fine was not paid, it was replaced with imprisonment for 4 months in prison," said Chief Justice Artha Theresia when reading the appeal decision in the courtroom of PT DKI Jakarta, Tuesday 10 September.

Not only criminal sanctions, but the panel of judges also imposed sanctions on SYL's replacement money of Rp. 44,269,777,204 and USD 30 thousand.

If the former Minister of Agriculture does not have the ability, then he will be replaced with a corporal sentence of 5 years.

"If you don't pay, your property will be confiscated and auctioned off by the prosecutor to cover the replacement money, provided that if the convict does not have sufficient property, he will be sentenced to imprisonment for 5 years," said Theresia.

In the first instance of the trial, Syahrul Yasin Limpo was sentenced to 10 years in prison. The verdict was read out by the judges of the Jakarta Corruption Court on Thursday afternoon, July 11, 2024.

In addition, SYL is also charged with paying a fine of Rp. 300 million and if it is unable to be replaced with imprisonment for 4 months.

"Imposing a sentence of 10 years in prison," reads the verdict at the trial read by the Panel of Judges, at the Jakarta Corruption Court (Tindak Pidana Korupsi).

In its ruling, the panel of judges also imposed sanctions for payment of replacement money of Rp. 14,147,144,786 and USD 30 thousand. The maximum is paid one month after this decision has permanent legal force.

"If you don't pay, your property will be confiscated and auctioned off by the prosecutor to cover the replacement money. With the provision that if the defendant does not have sufficient property, he will be sentenced to 2 years imprisonment," he said.

In this case, SYL violated Article 12 letter e in conjunction with Article 18 of Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code (KUHP) in conjunction with Article 64 paragraph (1) of the Criminal Code.
