A Man Imprisoned 5 Years For Forcing His Wife Who Is Suspected Of Having An Affair Makes His Name Tattoo

JAKARTA - A man in his 20s was sentenced to five years in prison for assaulting his wife, forcing him to tattoo his name on his body, because he suspected his wife was having an affair.

The first Division of the Supreme Court, chaired by Judge Noh Tae-ak on Tuesday, upheld a lower court ruling, confirming a five-year prison sentence for a 29-year-old man named Kim, who was charged with multiple offenses, including unauthorized and aggravating detentions that led to injury, assault and coercion.

Kim was tried for repeatedly attacking his wife after suspecting him of having an affair, shortly after being released from prison in July last year.

He reportedly threatened him, saying, "If you trust me sincerely, make a tattoo on your body," and force him to tattoo sentences like "I will live forever as a woman (Kim's name)" on four different parts of his body.

Kim was also accused of locking his wife at home for 9 hours 30 minutes while attacking her during interrogation of the alleged affair, which resulted in injury, including the rupture of eardrums.

He also forcibly cut his wife's hair with scissors and told her to watch a snake video, saying, "Every moment for me is a million times more painful than your hatred of snakes."

The first trial sentenced Kim to five years in prison. The court said, "The victim is believed to have experienced great fear and pain, and the injury rate suffered by the victim is not mild," adding Kim's notes consisting of seven previous sentences for violent crimes were a burdensome factor.

On the other hand, the existence of compensation of 13 million won and the victim's legacy so that Kim does not law, is a mitigating factor.

In the second trial, Kim claimed he was in a declining state of mental capacity at the time the crime occurred, but the court did not accept this argument.

The appeals court ruled, "While it can be seen that it is somewhat prone to impulse control at the time the crime occurs, it cannot be considered equivalent to someone suffering from mental illness."

The Supreme Court also considered this decision appropriate and rejected Kim's appeal, so that the five-year prison sentence imposed on him remained in effect.
