The Judicial Commission (KY) has recommended light sanctions to one of the judges regarding the interlocutory decision of former Supreme Court Justice Gazalba Saleh for violating the Code of Ethics and Code of Conduct of Judges (KEPPH).
"Through the plenary session, KY decided that one of the judges who tried the case was recommended to be given a light sanction in the form of a written dissatisfied statement," said KY Member and Spokesperson Mukti Fajar Nur Dewata in a statement in Jakarta, Antara, Tuesday, September 3.
Meanwhile, two other reported judges who decided on the interlocutory decision were not proven to have violated the KEPPH, so their good name would be restored.
"“KY will restore the good name of the reported judge through a letter that was copied to the judge's superior in stages," said Mukti.
Previously, the Corruption Eradication Commission (KPK) reported that the panel of judges granted Gazalba Saleh's memorandum of objection or exception in the alleged corruption case handling case at the Supreme Court (MA).
Mukti explained that KY had processed the report in accordance with applicable procedures. The examination process has been carried out on the complainant and witness, as well as examination or clarification of the reported panel of judges.
"This examination is the right to be responsible for alleged violations of the KEPPH reported by the reporter, as well as findings from the results of the examination of witnesses and the evidence obtained by KY," Mukti said.
It is known, Gazalba stumbled upon a case of alleged corruption in the handling of cases in the Supreme Court. In that case, Gazalba was charged with receiving gratuities and committing a crime of money laundering (TPPU) with a total value of Rp62.89 billion.
The panel of judges at the Corruption Court (Tipikor) at the Central Jakarta District Court, Monday (27/5), granted Gazalba's exception. The panel of judges consisted of Fahzal Hendri as chairman, with Rianto Adam Pontoh and Sukartono as members.
The Jakarta Corruption Court ruled that the prosecution and indictment of the KPK public prosecutor could not be accepted, and ordered Gazalba to be released from detention. However, the KPK filed an appeal against the interim decision.
Meanwhile, the DKI Jakarta High Court, Monday (24/6), decided to accept the request for an appeal against the KPK. The High Court canceled the decision of the Jakarta Corruption Court which granted Gazalba's objection note.
