LBH Muhammadiyah: Subscription Parking In Medan Is Not Valid

The Regional Leadership Legal Aid Institute (LBH-AP) of Muhammadiyah North Sumatra (North Sumatra) stated that subscribing parking in Medan City is invalid and must be revoked. "If the application of perwal (regulation of the mayor) parking to subscribe contains many legal, economic and social issues. So it is illegal, and must be revoked," said North Sumatra Muhammadiyah LBH-AP Chairman Ismail Lubis in Medan, Antara, Sunday, July 21. "This regulation also regulates the burden of forcing the community, because it can be seen in Article 8 paragraph (2) letter c that there must be public approval," he explained. Ismail said that the regulation should go through the Medan City DPRD as well as the public test process, so that the implementation of checks and balances in the government system must be fulfilled. He emphasized that if the Medan City Government still enforces its will by still implementing a subscription parking regulation, then it is a form of maladministration action. "The application of the subscription parking is not based on the legal basis or illegal levies," said Ismail. However, if you want to carry out a subscription parking regulation policy, it must be regulated in a regional regulation made with the Medan City DPRD and involve elements of the community, study, discussion and socialization. "We ask the Indonesian Ombudsman Representative of North Sumatra to conduct an examination related to alleged maladministration violations," said Ismail again. Head of the Medan City Transportation Agency, Iswar Lubis, emphasized that the parking lot of shops and supermarkets and the like in Medan City will soon enter the subscription parking program. "So far, the courtyard of shops and supermarkets have entered the regional parking tax. But soon we will manage it," said Iswar, in Medan, Thursday (18/7). Medan City DPRD chairman Hasyim admitted that he had never approved the Medan City Regulation on Subscription Parking launched by Medan Mayor Bobby Nasution on Medan City's 434th Birthday on July 1, 2024.

According to him, subscription parking is regulated in Mayor Regulation (Perwal) Number 26 of 2024 concerning Guidelines for the Implementation of Subscription Parking Services in the Road Bank. "Public parking does not have a regional regulation, and it is regulated by Perwal. There is no coordination, no approval from the DPRD. Until today, the DPRD has never knocked on the hammer to ratify the parking of subscriptions," said Hasyim.
