Child Pornography Case Files With Suspect Bagas Arista Declared Complete

JAKARTA - Head of the Public Information Division of the National Police Public Relations Division, Kombes Pol. Erdi A Chaniago, said that the case file for child pornography with one suspect, Bagas Arista Herlyanto (BAH), had been declared complete or P21 by the East Java High Prosecutor's Office (Kejati).

Erdi, explained that the child pornography case was allegedly carried out by the owner, user, and/or the ruler of the darksidexx email account @gmail.com and the [email protected]; aka the owner, user, and/or the ruler of the telephone number [phone]xxx.

Based on the Police report Number: LP/A/9/V/2024/SPKT.DITTIPIDSIBER/BARESKRIM POLRI, dated May 22, 2024, the investigation of cases of alleged child pornography by owners and/or users and/or the owner of the darksidexxx email [email protected] and [email protected] alias owner and/or owner of mobile number [phone]xxx, as received by the P21 letter from the public prosecutor with one suspect on July 16, 2024," Erdi said as quoted by ANTARA, Sunday, July 21.

Furthermore, Erdi said that BAH creates child pornography content from September 2022 to June 2023. The content was uploaded to darksidexx @gmail.com email, then stored on his device and laptop.

A total of approximately 100 photos produced by BAH for personal consumption. Sadly, said Erdi, the object of the case is children with the initials D, who are none other than the suspect's nephew.

"The submission of the suspect and evidence or phase two will be carried out on Tuesday, July 23, 2024 at the Gresik District Attorney's Office," Erdi added.

In this case, investigators confiscated a number of evidences from the suspect, including one identity card on behalf of the suspect, one black Oppo brand device, one Realme brand device, two smartphone sim cards, one black HP laptop, seven email accounts, and one loose scale (flash disk) containing the suspect's email export results.

The suspect was charged with Article 45 paragraph (1) in conjunction with Article 27 paragraph (1) of Law Number 9 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions and/or Article 29 jo. Article 4 paragraph (1) and/or Article 37 jo. Article 11 of Law Number 44 of 2008 concerning Pornography and/or Article 64 paragraph (1) of the Criminal Code.

BAH carries a maximum penalty of 12 years in prison and a maximum fine of Rp. 6,000,000,000.00.
