Yasonna Asks Notaries To Be More Professional To Prevent TPPU And Terrorist Funding

JAKARTA - Minister of Law and Human Rights Yasonna Laoly, emphasized the importance of professional supervision of notaries to support a conducive economic climate. Including ensuring notaries can help prevent money laundering and terrorist financing.

This was conveyed in the Inauguration and Oath of the Interim Substitute Position of the Notary Central Supervisory Council, the Interim Honorary Council of the Central Notary for the 2022-2025 Period, and the Inauguration and Oath of the Position of the Supervisory Committee for the 2024-2027 Intellectual Property Consultant.

Yasonna said, notary as an official authorized to make an authentic deed, must carry out his duties with high sensitivity and due diligence. Notaries play an important role in supporting government administration and Indonesia's economic progress.

Yasonna highlighted the importance of legal adaptation to create a conducive climate for business actors and investors.

"As a general official authorized to make an authentic deed, notaries are expected to have sensitivity in due diligence. This is to create a sense of security for the service user community, as well as for the notary itself," said Yasonna, Thursday (6/6/2024).

Improved regulations such as simplification of the business entity's establishment process are the government's steps to increase the ease of doing business. In addition, supervision of notaries must also be tightened to prevent money laundering (TPPU) and terrorism financing.

Yasonna emphasized the importance of the role of the Supervisory Council and the Honorary Council of Notaries in imposing sanctions on notaries who violate the law. He also asked the panel to support law enforcement officers in the process of investigation, prosecution, and trial of problematic notaries.

The number of notaries that cause a lot of unhealthy competition can reduce public trust. Therefore, members of the assembly are expected to have a high commitment and continue to update their knowledge according to the development of regulations," said Yasonna.

Menkumham also highlighted that Indonesia's participation as a member of the Financial Action Task Force (FATF) can show the country's seriousness in fighting TPPU and TPPT. Effective notary supervision is expected to increase the trust of investors and business actors, which in turn will encourage economic growth and community welfare.

Yasonna also reminded notaries to apply the Principle of Recognizing Service Users (PMPJ), filling in Beneficial Ownership (BO) data, and reporting suspicious financial transactions through the Government Anti-Money Laundering (goAML) application.

Professional and comprehensive supervision of notaries is absolutely necessary to maintain the integrity of the legal system and support the national economy through the Ministry of Law and Human Rights as supervisors whose duties and functions are in the Directorate General of General Legal Administration (Ditjen AHU).
