Asking PSI's Voice To Be Zero In Central Papua, The Constitutional Court For PDIP Value Is Not Enough Evidence

JAKARTA - The Constitutional Court (MK) stated that PDIP did not have enough evidence in the prosecution to negate the votes of the Indonesian Solidarity Party (PSI) in a number of selected areas (dapil) of Central Papua in the 2024 Legislative Election yesterday.

These demands are contained in the petition for a lawsuit for dispute over the results of the 2024 Legislative Election submitted by PDIP to the Constitutional Court regarding the vote acquisition in 5 electoral districts in Central Papua, namely the Central Papua electoral district 3, Central Papua 5, Puncak 2, Puncak 3, and Puncak 4.

Initially, PDIP's attorney believed that voting in 5 Central Papua electoral districts used a noken system. However, PDIP's attorneys cannot confirm whether the 5 electoral districts use a noken system or not.

"This connected system is pure or is there still a component of your electoral district (the power of the PDIP public) using the one man one vote system? That can't be answered yet, right? Okay," said judge Guntur Hamzah at the 2024 Pilleg PHPU trial at the Constitutional Court Building, Central Jakarta, Monday 29 April.

Guntur admitted that he could not find enough evidence related to the PDIP petition that wanted to eliminate PSI's voice in the Central Papua electoral district 5.

"Brother, it's zero, in the Central Papua electoral district 5 for PDI-Perjuangan. Now, you zero PSI votes. Now, brother, I'm looking for supporting evidence whether this is true you have... because this is a connect system according to you. Well, I don't see that there is data evidence to zero it," said Guntur.

Guntur also asked the PDIP attorney to include additional evidence related to the request to eliminate PSI votes in the Central Papua electoral district 5. Evidence participation is carried out so that the KPU as the relevant party and Bawaslu can be asked for a response.

PDIP's attorney on that occasion did not provide any response. Meanwhile, the constitutional judge who is also the Chair of the Panel Arief Hidayat said PDIP as the applicant could include evidence until before the 2024 PHPU decision hearing.

It's just that, said Arief, the participation of evidence carried out other than Monday will be assessed by the Constitutional Court judges. The reason is that the KPU and Bawaslu may not give a response when there is new evidence.

"If the applicant's evidence is not submitted at the first trial, the preliminary trial, it will be the judge's assessment in the verdict trial. For what reason? Therefore, it cannot be verified and cannot be responded to by the relevant parties and the respondent or Bawaslu. So, the applicant should in this trial have completed additional evidence," explained Arief.

Previously, PDIP asked the Constitutional Court (MK) to nullify the votes acquired by the Indonesian Solidarity Party (PSI) in Central Papua Province.

"Determining PSI for PSI's vote acquisition D as a result of sub-district 0, D's vote acquisition is the result of province 0," said PDIP attorney Wiradarma Harefa while reading the petitum at the trial at the Constitutional Court Building, Central Jakarta, Monday, April 29, 2024.

In its petitum, PDIP recorded the vote acquisition of parties in the Central Papua electoral district V (Mitika Regency), Puncak Regency for the Second, III, and IV electoral districts, as well as the Central Papua Provincial DPRD for the Central Papua electoral district III of Puncak Regency for the election of DPRD members.

PDIP claims to have received 36,753 votes in the Central Papua electoral district V. This is also based on the result D form. In addition, PDIP should have received votes in the electoral districts II, III, and IV in Puncak district of 25,282 votes.

"One, Beoga district electoral district 2 votes of 7,939 votes, West Beoga district electoral district 2 (2,498 votes), district Ogamanin electoral district 2 (4,583 votes), district East Beoga district electoral district 2 (800 votes), district Yugumoa electoral district 3 (1,459 votes), district Sinak electoral district 3 (2,281 votes), district Mageabume electoral district 3 (2,018 votes), district Doufa and derfos electoral district 4 (3,704 votes). The total votes obtained by the applicant are 25,282 votes," explained Wiradarma.

"PDIP obtained D votes from districts or sub-districts 36,753, D as a result of the province 36,753 votes," he continued.
