Alleged Judge Guntur Langgar Ethics, MKMK Examines ForMASI Reporter Witness

JAKARTA - The Honorary Council of the Constitutional Court (MKMK) held a trial to examine the reporting witness on reports of alleged ethical violations by Constitutional Justice Guntur Hamzah. The reporting witness in this case is the Constitutional Concerned Student Forum (FORMATION),

"The agenda is to hear the testimony of witnesses," said Chief Justice of the MKMK I Dewa Gede Palguna when confirmed in Jakarta, Tuesday.

The examination hearing for Case Number 06/MKMK/L/04/2024 was chaired directly by the Chairman of the MKMK I Dewa Gede Palguna together with MKMK members Yuliandri and Ridwan Mansyur. The trial was held closed in the Panel Courtroom, Building 2 MK, Jakarta.

Palguna said the reporting parties presented three experts, namely Ahmad Siboy, Ibnu Samwidodo, and Basuki Kurniawan. The three are administrators of APHTN HAN East Java (East Java).

One of the witnesses named Ahmad Siboy said, if it is guided by the organization's AD / ART, the term chairman is not known to be inactive and all there is is only the executor of the task.

"Based on Article 26 paragraph (1) AD/ART APHTN HAN, the central management and regional administrators who become state officials or regional officials must resign from their positions. Meanwhile, the term of office of the reported party as chairman is still until 2025 and is currently the inactive chairman," said Ahmad who attended the trial online.

Palguna also revealed that prior to the witness examination trial, his party had summoned Guntur as the reported judge for questioning, but he did not reveal the contents of the meeting.

The next stage, he continued, is the reading of the verdict on Thursday, April 25 afternoon. "Currently, the decision is being drafted. The plan is for the decision to be pronounced on April 25, 2024 afternoon. Later there will be a notification to the public," he said.

Previously, Guntur was reported to MKMK by FORMASI on suspicion of violating the code of ethics because he served as Chair of the Association for Constitutional Law and State Administrative Law (APHTN HAN). In a preliminary hearing held on Tuesday, April 16, the FORMASI said the position could allow communication between the management or members of APHTN HAN and Guntur in relation to an expert in a case that was tried at the Constitutional Court. In addition to the FORMASI, Guntur was also reported by the Constitutional Activists Movement (GAS) for its connection with the Constitutional Court Decision Number 90/PUU-XIX/2023.

GAS suspects Guntur actually violated the code of ethics because he consistently wants to grant the petition submitted by the applicant in the case. Therefore, GAS asked the MKMK not to involve Guntur in handling the 2024 General Election Result Dispute (PHPU) case.
