Dissenting Opinion Judge Saldi Isra: Trial Proves Deployment Of Regional Heads In 'Bandeng Kandang'

Constitutional Justice Saldi Isra assessed that the Acting Governor (Pj) to regional heads in several non-neutral areas in the 2024 Presidential Election (Pilpres). This is one of the reasons for different opinions or dissenting opinions with other constitutional judges behind the decision of the Constitutional Court (MK) which rejected the petition from Anies Baswedan and Muhaimin Iskandar regarding the Dispute over the General Election Results (PHPU) of the President and Vice President 2024. "After reading Bawaslu's statement and the facts revealed in court and observing the evidence of the parties carefully, I found that there was a problem with the neutrality of the Acting Head," said Saldi during a trial at the Constitutional Court, Monday, April 22. In fact, it is believed that there was an action by the village head that occurred, including in North Sumatra, Jakarta, Banten, Central Java, West Kalimantan, and South Sulawesi. Saldi explained the form of irregularities in the Acting Regional Head, including the mobilization of ASN and the allocation of village funds as campaign funds. "The call is open to choosing a candidate pair who has a clear commitment to the continuation of IKN, the distribution of social assistance or other assistance to voters by using bags that are identical to the identity of certain candidate pairs," he said. "The implementation of mass activities using clothes and costumes emphasizes partiality to certain candidate pairs, the installation of campaign organizers in regional government offices as well as invitations to choose candidate pairs on social media and government-owned buildings," continued Saldi. Regarding the deployment of regional heads, Saldi said it was revealed at the trial in several areas such as Jakarta and Central Java. "It was also revealed as a fact in the trial that there was the deployment of village heads, including Jakarta and Central Java," said Saldi.

It is known, the Constitutional Court rejected Anies-Muhaimin's request. The court considered that the arguments submitted by the applicant were not based on law. "Reject the applicant's application in its entirety," said Chief Justice of the Constitutional Court Suhartoyo when reading the verdict.
