Law Enforcement Firmness Can Minimize Gejolak After The Constitutional Court's Decision

JAKARTA Professor of Constitutional Law at Bhayangkara University, Juanda assessed that the firmness of law enforcement officers was able to minimize the impact or political turmoil that could arise after the Constitutional Court (MK) issued a decision on the Dispute of General Election Results (PHPU) for the 2024 presidential election.

The turmoil usually appears when law enforcement officers are not perpendicular to the Constitutional Court's decision. We urge, whatever the decision is, law enforcement officers will continue to oversee the decision. If that can be done by law enforcement officers, then the Constitutional Court's decision can be carried out properly and properly for the benefit of the nation," he explained, Sunday, April 21, 2024.

According to him, all decisions in a dispute are of course parties who are satisfied and dissatisfied. Therefore, the Constitutional Court Panel of Judges is expected to issue a really fair decision based on the facts and evidence presented at the trial.

Juanda emphasized that as long as all parties in dispute admit that the Constitutional Court is the right place to seek justice, whatever decision is issued will not cause turmoil.

Although, because it involves politics, of course there will be political turmoil that arises. Therefore, the Constitutional Court Panel of Judges should not consider political aspects, it must be based on legal aspects in making decisions.

"Including the request to disqualify Gibran Rakabuming Raka. If the facts and evidence are strong, the panel of judges does not need to worry about deciding," said Juanda.

Meanwhile, a political observer from Al Azhar University Indonesia, Ujang Komaruddin, said that whatever decision the Constitutional Court issued, it was a consequence of a journey through the democratic process.

"Whatever the decision is, that is democracy, because all the power and efforts have been made by all interests and all competing camps to follow the democratic path, including election disputes in the Constitutional Court," he said.

"Yes, I think the situation will be conducive and kind, safe, because the Indonesian people are adults because the democratic process must be respected because it is actually justice given by the Constitutional Court and let's unite whatever the decision must be respected," continued Ujang.
