The AMIN National Team Believes That The Constitutional Court Is Disqualifying Gibran: Prabowo Is Required To Change The Vice Presidential Candidate

JAKARTA - Deputy Chairman of the National Legal Team (THN) of the National Team for Winning Anies-Muhaimin (AMIN) Sugito Atmo Prawiro, believes that the Constitutional Court (MK) will disqualify candidate for vice president (cawapres) number 2 Gibran Rakabuming Raka in his decision regarding the Dispute of General Election Results (PHPU) in the 2024 presidential election.

Sugito is optimistic that the decision will be taken by the Constitutional Court as the best decision to be read out on Monday, April 22.

"If it is related to the facts of the trial and the trial process that is being carried out, I am very optimistic that there is potential for disqualification. At least it is disqualification for vice presidential candidate number 2," said Sugito in a discussion on the MNC Trijaya Polemic entitled Waiting for the results of the Constitutional Court's Decision, Saturday, April 20. With the disqualification of the vice presidential candidate number 2, according to Sugito, a re-election will automatically be held which requires Prabowo Subianto to look for another vice presidential candidate to replace Gibran.

"At least the disqualification of vice presidential candidates will be followed by a re-voting, and presidential candidate Prabowo number 2 is required to replace the vice presidential candidate," said Sugito. "And that's actually a lot of examples that have occurred in the regional election as well," he added.

Furthermore, Sugito reminded that the KPU's decision Number 1632 of 2023 was not related to the KPU's decision Number 23, but still used the KPU's decision Number 19 of 2023.

"In fact, after the stipulation that in KPU decision number 19, it was explained that for the requirements of the president and vice president after the age of over 40 years," said Sugito.

Sugito also mentioned that other reasons that strengthen the Constitutional Court can disqualify the vice presidential candidate number 2. Namely the decision from the DKPP. In the decision, said Sugito, the KPU is considered to have violated the code of ethics related to the receipt of Gibran's vice presidential candidate registration which is not yet 40 years old.

"So in my opinion, the others are just additional accessories, but from the juridical facts in the trial it is very encouraging that the potential for disqualification of serial number 2 is several very large," he explained.
