The Constitutional Court Reveals The Reason Amicus Curiae Megawati Can Be Considered

JAKARTA - The Constitutional Court (MK) decided to consider amicus theft or a court friend sent by the 5th President Megawati Soekarno Putri because she passed the administrative ceremony. The Constitutional Court did not consider amicus theft which was filed after April 16, 2024, to the judge's deliberation meeting (RPH).

MK spokesman Fajar Laksono said the reasons for limiting the consideration were the decisions of the panel of judges.

"That's the decision of the panel of judges, maybe because the conclusion was also submitted at 16.00 WIB, that was yesterday. Since then, all files including conclusions have become the material studied, studied, investigated and considered by the panel of judges. If it is not restricted, this RPH will continue. Later, there will be a lot of entry, it will affect the discussion or decision making," he said, Thursday, April 18.

Fajar explained that as of Thursday afternoon, the number of amicuses submitted had reached 33 submissions. Of the 33 proposals, only 14 amicus thefts were submitted before April 16, 2024. Among the 14, Fajar said one of them was an amicus stealee of PDIP General Chair Megawati Soekarnoputri.

"There are 14, to date there are 33. Today there are 10, yesterday 23, a total of 33. If there is a split which one is April 16, there are 14. Well, those 14 that have been investigated by the judge until today. It doesn't mean that it will be considered, consider it or not later, but the important thing is that the 14 amicus theft has been handed over to the judge and has been read and observed," explained Fajar.

Nevertheless, he ensured that the Constitutional Court would still accept the amicus theft submitted after April 16, 2024.

"We accept yes, we just administrativeize, that we receive tens of them. This includes our accountability. We accept all of this from anyone. We administer this well, we report it to the leadership. Thank God later if it can be published. The point is that we continue to administer it properly, not then we accept it and then it is treated inappropriately," said Fajar.
