The Constitutional Court Opens The Stages Of Conclusion Submission In The Presidential Election Lawsuit Session

JAKARTA - The Constitutional Court opened the stages of delivering conclusions in the handling of the 2024 Presidential Election Result Dispute (PHPU) case after the end of the trial stages of the case.

"We, the panel of judges, agree that there are things that still want to be submitted, even though this is the last trial, can be accommodated through conclusions," said Chief Justice of the Constitutional Court Suhartoyo at the end of the follow-up trial of the 2024 presidential election PHPU case, reported by ANTARA, Friday, April 5.

Suhartoyo said the confirmation of the conclusion in the previous presidential election PHPU trial was not mandatory. However, in the 2024 presidential election PHPU case, there are many dynamics that are different from before so that the Constitutional Court accommodates the submission of crucial things and submission of files that are still lagging behind through these stages.

He said related parties, namely the legal team of the Prabowo-Gibran Defenders Team, had not submitted witness and expert statements. The files can be submitted at the stage of submitting conclusions.

In addition, at this stage, the parties were also allowed to respond to the four ministers of the Advanced Indonesia Cabinet who had been questioned, namely Coordinating Minister for Human Development and Culture Muhadjir Effendy, Coordinating Minister for the Economy Airlangga Hartarto, Minister of Finance Sri Mulyani Indrawati, and Minister of Social Affairs Tri Rismaharini, as well as to the Election Organizers Honorary Council (DKPP).

On a separate occasion, the Constitutional Court Judge Enny Nurbaningsih explained that the decision to give the stages of submitting the conclusion came from the results of the Hakim Consultative Meeting (RPH).

"It's not in the Constitutional Court Regulation (PMK), but RPH also has the right to then make rules outside of that. It doesn't give weight to the parties, it's also profitable for them to make conclusions," said Enny.

Enny explained that the final limit for expressing conclusions was April 16, 2024 at 16.00 WIB. This stage is opened to those who are willing to conclude and are not required.

"This is indeed opening up new and special opportunities in the PHPU for the presidential election. That is their right. If they feel they don't want to, that's okay," he said.

He also emphasized that the stage of submitting the conclusion was to provide conclusions about the stages of the trial and should not be used for the applicant to confirm the contents of his petition.
