Civil Sue Ferdy Sambo Et Al, Birigadir J's Lawyer Hopes Mediation Reaches Agreement

JAKARTA - The head of the family attorney team Brigadier Nofriansyah Yosua Hutabarat or Brigadier J, Kamaruddin Simanjuntak hopes that the mediation that will be carried out by the South Jakarta District Court mediator with several defendants can find common ground.

"In mediation, we will ask everything we sue for," said Kamaruddin Simanjuntak as quoted by ANTARA, Tuesday, March 19.

Brigadier J's family filed a civil lawsuit against Ferdy Sambo, Putri Candrawathi, Richard Total, Ricky Rizal, Strong Ma'ruf, State of the Republic of Indonesia Cq Kapolri and was also sued by two Ministers of Finance as much as Rp7.5 billion for the killing of Yosua.

According to him, the reason the family sued the defendants was because they had been harmed by the death of Nofriansyah Yosua Hutabarat who was killed by the convicts.

Komarudin said the losses suffered by his client after being calculated reached Rp7.5 billion and that was a material loss.

"There is also material losses that we will propose at a civil trial at the South Jakarta District Court," he said.

Another lawyer for Brigadier J, Johanes Raharjo, said that mediation is a mechanism that must be pursued in the civil trial process, without mediation a civil trial can be formally flawed.

Therefore, said Raharjo, mediation to reach an agreement lasted 30 working days. If mediation does not meet a meeting point, it is included in the subject matter of the case.

"In principle, we submit it to the mediator, hopefully the mediation will produce the best in accordance with our petition, if there is an offer from the defendant that is not appropriate, we will have to hand it over to the panel of judges," he said.

The South Jakarta District Court (PN) has begun hearing the civil lawsuit case filed by the family of Brigadier J even though the defendant one President was not present at the trial.

"We are taking a policy to continue the trial, because this is of the defendant's nature. The defendant is only obedient and obedient to the verdict," said South Jakarta District Court Chief Justice Hendra Yuristiawan.

According to him, the absence of the President or representing the trial of Brigadier J's civil lawsuit did not affect the proceedings.

For this reason, the Panel of Judges of the South Jakarta District Court (Jaksel) has agreed to continue the trial. "Because the parties have been present together and we consider it complete, the process will continue with the mediation process," he said.
