New Rules Of The Ministry Of Health, Healthcare Practice Permits No Need For Recommendation Of Professional Organizations

JAKARTA - The Ministry of Health (Kemenkes) issued a circular (SE) regarding the implementation of licensing for medical personnel and health workers (nakes) after the issuance of Law Number 17 of 2023 concerning Health.

In the circular, health workers can obtain a practice permit (SIP) only with a registration certificate (STR) and a description of the place of practice, without the recommendation of professional organizations.

"Yes, there is no need for recommendations from professional organizations," said Head of the Bureau of Communication and Public Services, Siti Nadia Tarmizi, Friday, January 19.

The circular numbered HK.02.01/MENKES/6/2024 has been issued by Minister of Health Budi Gunadi Sadikin on January 12, 2024. The SE followed up on Law Number 17 of 2023 concerning Health which was signed by President Joko Widodo (Jokowi) on August 8 last year.

Nadia said the circular regulates procedures for licensing and becomes a reference for institutions authorized to issue SIP for medical personnel and health workers.

Furthermore, he said that the Health Law Number 17/2023 - Law Number 17/2023 concerning Health broadly regulates three things related to SIP. First, the issued SIP is declared still valid until the SIP period ends.

Second, the issuance of the SIP which has been completed in the verification process and meets the requirements will be completed immediately and declared valid until the end of the SIP.

"Finally, the issuance of SIP which is still in the initial process before verification is adjusted to the provisions in Law Number 17 of 2023 concerning Health," said Nadia.

The provisions for licensing for medical personnel and health workers are issued by the district/city government with the following details:

1. Application and extension of SIP

Medical personnel and health workers who apply for the issuance of SIP or the extension of the validity period can apply for issuance of SIP to the head of the district/city health office or the head of the one-stop integrated investment and service office in districts/cities where medical personnel and health workers carry out their practices.

The head of the district/city health office or the head of the one-door investment and integrated service office in districts/cities issues the number of SIPs in accordance with the provisions of the legislation.

2. SIP application with STR is still valid

Medical personnel or health workers who apply for the issuance of SIP for the first time with a registration certificate (STR) that has been issued and is still valid before Law Number 17 of 2023 concerning Health are promulgated to attach a STR and a certificate of practice place.

The head of the district/city health office or the head of the investment and integrated services office, one door to the district/city area, issued a SIP whose validity period was in accordance with the STR validity period.

Medical personnel and health workers who apply for the issuance of SIP for the first time with a life-long STR for medical personnel and health workers who have graduated for less than five years, before Law Number 17 of 2023 concerning Health are invited to attach a STR and a certificate of place of practice.

The head of the district/city health office or the head of the investment and integrated services office, one district/city gate, issued SIP which was valid for five years.

3. SIP application with STR, but not five years of practice

Medical personnel and health workers have had STRs that are valid for life but have never practiced more than five years, starting before Law Number 17 of 2023 concerning Health was promulgated and will apply for issuance of SIP, having to attach STR, certificate of practice, and proof of competence fulfillment.

"The proof of the fulfillment of competence is obtained after participating in the fulfillment of competencies organized by the ministry that organizes government affairs in the health sector in coordination with collegium or education administrators," explained Nadia.
