JAKARTA - The Minister of Communication and Information (Kominfo), Johnny G Plate, said that his ministry would formulate guidelines for implementing Law Number 19 of 2016 concerning Electronic Information and Transactions (UU ITE).

The team from Kominfo, he said, would make specific guidelines for crucial articles in the law. So, it is hoped that there will be no more multiple interpretations in the ITE Law, especially for law enforcement officials so as to prevent disputes.

"Guidelines for implementing the law are made as a reference for law enforcement officials in following up on the ITE Law if there is a dispute or dispute related to the ITE Law either by the Indonesian Police, the Attorney General's Office, or other institutions in the physical space and of course by Kominfo in the room. digital", Johnny said in a press conference with the Coordinating Minister for Political, Legal and Security Affairs Mahfud MD, which was broadcast on the YouTube Kemenko Polhukam channel, Monday, February 22.

Johnny thinks this guideline is not a new legal norm. So, he asked the public not to interpret this guideline as a new law.

"Because it is clear, the explanation of the Law is already in the section on the explanation of the Law and the final interpretation in the implementation of our judicial system and for people who seek justice is the judge's authority", he said.

In addition to creating a guideline team, Kominfo also formed a joint team with other ministries and institutions to follow up on President Joko Widodo's (Jokowi) orders regarding the revision of the ITE Law.

The team established two sub-teams, namely the first team led by the Ministry of Communication and Information's Expert Staff for Legal Affairs Henri Subiakto and the second team led by the Director-General of Laws and Regulations of the Ministry of Law and Human Rights, Widodo Ekatjahjana.

As previously reported, the Coordinating Minister for Political, Legal, and Security Affairs Mahfud MD followed up on President Joko Widodo's (Jokowi) instructions to review the proposed revision of the Information and Electronic Transaction Law (ITE). There are two teams formed by Mahfud MD to review so that there will be no more rubber articles if the ITE Law is revised.

"The Coordinating Ministry for Political, Legal and Security Affairs which has the task of solving the problem of the ITE Law which contains the following contents: one, making implementation criteria so that the catch-all articles does not occur. The second is to study the possibility of revising the revision of the ITE Law”, said Mahfud MD, Friday, February 19.

Mahfud MD explained the duties of the two teams formed by the Coordinating Ministry for Political, Legal, and Security Affairs. The first team made technical interpretations and prepared criteria for articles of the ITE Law which were considered rubber articles.

"That will be carried out by the Minister of Communication and Information, by the Ministry of Communication and Information, Mr. Jhonny Plate, with his team, but also with other ministries under the coordination of Coordinating Ministry for Political, Legal and Security Affairs (Polhukam) for this matter", said Mahfud.

Meanwhile, the second team was tasked with reviewing the proposed revision of the ITE Law. President Jokowi called Mahfud asked that articles that were considered discriminatory to the public as well as on catch-all articles be discussed.

"We discuss it openly. This team will invite experts, will hear the Indonesian Journalists Association (PWI), will hear all experts will be heard, the pro-democracy movement NGOs will be heard to discuss whether this needs revision”, he continued.

If from the results of the study, the ITE Law is deemed necessary to be revised, according to Mahfud, the government will communicate with the House of Representatives (DPR). Mahfud will certainly hear input from the DPR.
