BANJARMASIN - The public prosecutor (JPU) asked the panel of judges at the Banjarmasin District Court to reject the exception of defendant Lian Silas, the father of drug kingpin Fredy Pratama.
The reason is that the indictment made in the case has met the formal and material requirements.
"We ask that the panel of judges who examine and those who hear the case on behalf of the defendant Lian Silas decide to reject all objections to the exception of the defendant's legal advisory team," said Mashuri, a member of the prosecutor's team during the follow-up trial of defendant Lian Silas at the Banjarmasin District Court, as reported by ANTARA, Tuesday, January 9.
According to Mashuri, there is no juridical reason to obstruct the public prosecutor's authority to file a prosecution against the defendant.
Therefore, all objections from the defendant's legal advisory team were not in accordance with the provisions of the legislation.
Mashuri also emphasized that the indictment of the public prosecutor Number Reg Case: PDM 488/BJRMS/2023 dated December 5, 2023 is legal and meets the requirements as stipulated in article 143 Paragraph (2) of the Criminal Procedure Code.
"So the panel of judges is requested to continue examining the case of defendant Lian Silas with the agenda of examining witness witnesses," he added.
After listening to the response of the exception by the Public Prosecutor, the panel of judges led by Jamser Simanjuntak again scheduled a hearing on Tuesday (16/1) next week for an interim decision.
