Chief Justice Of The Constitutional Court Reminds MKMK To Permanently Maintain Independence

JAKARTA - Chairman of the Constitutional Court (MK) Suhartoyo reminded three members of the MKMK to be permanent to maintain independent and implicit in handling all complaints related to the judge's ethical problems.

"The essence is institutionally in the name of the Constitutional Court, which really expects the three of you to be independent and implicit," Suhartoyo said after inaugurating three MKMK members in Jakarta as reported by ANTARA, Monday, January 8.

According to Suhartoyo, independence and equality in solving a judge's ethical case are the main essence of being born to the permanent MKMK.

By maintaining this independence, according to him, the Constitutional Court, which has recently received negative sentiment from the public, will grow again.

Chief Justice of the Constitutional Court Suhartoyo inaugurated three members of the permanent Constitutional Court Honorary Council, namely judge Ridwan Mansyur, community leader I Gede Palguna, and academic University Andalas Yuliandri.

"We should be grateful that this afternoon we were able to witness the oath of oath from members of the Honorary Council of the Permanent Constitutional Court," Suhartoyo said while reading his remarks at the inauguration of permanent MKMK members at the Constitutional Court Building, Jakarta, Monday.

The three were sworn in based on Decree Number 1 of 2024 concerning the Establishment and Membership of the Honorary Council of the Constitutional Court 2024 dated January 2, 2024.

They will carry out their duties as members of the MKMK from January 8 to December 31, 2024.

The establishment of the Constitutional Court is a mandate of Article 27A paragraph (2) of Law Number 7 of 2020 concerning the Constitutional Court.

The article states that to enforce the Code of Ethics and Code of Conduct of Constitutional Justices, a Constitutional Honorary Council was formed.

Following up on these provisions, on February 3, 2023, the Constitutional Court has stipulated Constitutional Court Regulation Number 1 of 2023 concerning the Honorary Council of the Constitutional Court (PMK 1/2023).

Based on PMK 1/2023, the Constitutional Court has the authority to maintain the dignity and honor of the Constitutional Court. In addition, the Constitutional Court is also authorized to examine and decide alleged violations of the Code of Ethics and Conduct of Constitutional Justices no later than 30 working days after the report was recorded.

Meanwhile, the three permanent members of the inaugurated MKMK have been unanimously agreed upon by all judges and meet all requirements, namely having integrity, honesty, and fairness, at least 60 years of age and having a broad perspective.
