JAKARTA - Deputy Speaker of the Indonesian House of Representatives, Sufmi Dasco Ahmad, confirmed that approval regarding the revision of the Constitutional Court (MK) law would not be held at the plenary meeting tomorrow. However, the postponement of the decision-making was not due to a letter from the Coordinating Minister for Political, Legal and Security Affairs, Mahfud MD.
Dasco explained that previously there had been approval from 9 factions and the Ministry of Law and Human Rights regarding the revision of the Constitutional Court Law. However, there was a letter from the Coordinating Minister for Political, Legal and Security Affairs which caused the factions to agree to postpone the plenary session.
Even so, said Dasco, the postponement of the agreement on the revision of the Constitutional Court Law was not only caused by the letter from the Coordinating Minister for Political, Legal and Security Affairs. But also on the agreement of the factions who want to avoid negative news related to the revision of the Constitutional Court Law.
Dasco emphasized that the DPR had already agreed that the postponement of the revision of the Constitutional Court Law would be brought to a plenary meeting before being asked by the Coordinating Minister for Political, Legal and Security Affairs, Mahfud MD.
"Today, the Coordinating Minister for Political, Legal and Security Affairs sent a letter to the leadership of the DPR and even though it had been agreed between the government, in this case the Ministry of Law and Human Rights and 9 factions from the DPR, but with an agreement from factions, this is not because of the letter sent, indeed yesterday it has been agreed from the factions to postpone the plenary session or to complete the decision making on the revision of the Constitutional Court Law," said Dasco at the Parliament Complex, Senayan, Jakarta, Monday, November 4.
Dasco assessed that the postponement was also a preventive measure even though the government and most factions had agreed on the contents of Article 87 of the Constitutional Court Law. Until when this revision was postponed, Dasco said, currently there is no certainty of time.
"If it is later in accordance with the agreement again from faction friends until when, which is certain that on December 5 tomorrow there will be no plenary revision of the Constitutional Court Law," said Dasco.
Dasco denied the issue of walking out in the Commission III consignment meeting on the Constitutional Court Bill with the government. He made sure that no party really left the courtroom.
Nevertheless, said Dasco, the revision of the Constitutional Court Law will still be discussed and finalized in accordance with the agreement of related factions.
“ In my opinion, no one walks out, right, because if there is one party who has permission to leave and then there is another party then it is inside, if it walks out it's like leaving the courtroom, that's about it,” concluded
Previously, Coordinating Minister for Political, Legal and Security Affairs Mahfud MD conveyed the government's stance that had not yet approved the revision of Law Number 24 of 2003 concerning the Constitutional Court (MK). One of the reasons is the objection to the transitional rules for the 10-year constitutional judge's term of office and a maximum pension of 70 years.
"That's true, we haven't approved it yet and technically procedurally there has been no decision on a level one meeting, that level one meeting means the government has signed with all factions.
