Revocation Of PDIP Report, Doesn't Affect Rocky Gerung's Case

JAKARTA - The team from the Legal Aid and People's Advocacy Agency or BBHAR of the PDI-P (PDIP) decided to withdraw reports of alleged spread of fake news and hate speech based on SARA with reported Rocky Gerung at the Police Criminal Investigation Unit.

The report began when Rocky was a speaker at an event. In the forum, Rocky criticized President Joko Widodo or Jokowi's move to go to China and offered to invest in IKN.

"Jokowi's ambition is to maintain his legacy. He is still going to China to offer IKN. He is still pacing from one coalition to another. To find clarity on his fate. He thinks about his own destiny, he doesn't think about our fate. It's a stupid guy," said Rocky in the video.

This statement is the main problem. However, over time, the PDIP DPP BBHAR camp changed its mind.

The report on the 'handlist' case will be withdrawn on the grounds that the statement made from Rocky Gerung's mouth regarding President Joko Widodo or Jokowi is considered to be true. Moreover, the attitude of the 7th President of Indonesia is considered to have changed.

"I decided to withdraw the report, what was conveyed by Rocky Gerung, I think it will be true for a long time. After I weigh it clearly, recently I saw that President Jokowi had changed," said a representative of BBHAR DPP PDI Perjuangan (PDIP) Johanneswaslin L. Tobing when confirmed, Tuesday, November 28, 2023.

Changes in attitude felt about leadership. He accused Jokowi of no longer prioritizing the people but personally and his family.

This is said to be reflected in the issue of the Constitutional Court's decision (MK).

"Especially after seeing the chairman of the Constitutional Court, it was proven that Uncle Usman (Anwar Usman) was dismissed from the chairman of the Constitutional Court. Before long, Gibran's son ran to become a vice presidential candidate. This is beyond my common sense as an anti-law violation. Breaking the law, defending every way for the ambition to rule," he said.

For that reason, reports that have been registered with the number LP/B/217/VIII/2023/SPKT/Bareskrim Polri, dated August 2, 2023, will be revoked.

However, this step did not affect anything in the process of handling the 'cheap my hand' case. This is because the Directorate of General Crimes at Bareskrim is still investigating it.

Karo Penmas, Police Public Relations Division, Brigadier General Ahmad Ramadhan, said that the investigation of the case would continue. The reason is that the alleged hate speech and the spread of fake news are not complaint offenses.

"The investigation is still ongoing. The reason for the investigators is because this is not a complaint offense," said Ramadhan.

In fact, it is said that not only the BBHAR PDIP DPP camp has withdrawn its report related to the case. However, it was not conveyed which parties took the same steps.

"There are 26 LPs (police reports) and several prisons have been revoked," said Ramadhan.

Rocky Gerung's case has gone up to the investigation stage. The police found a criminal element committed by Rocky Gerung. However, investigators from the Dittipidum Bareskrim Polri have not yet named a suspect.

Rocky Gerung was charged with Article 14 Paragraph (1), Paragraph (2), and/or Article 15 of Law of the Republic of Indonesia Number 1 of 1946 concerning Criminal Law Regulations. Then, Article 156 of the Criminal Code and/or Article 160 of the Criminal Code and/or Article 45A Paragraph (2) in conjunction with Article 28 Paragraph (2) Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE).
