Makassar KPU: Lawsuit 8 PPK Rejected By PTUN

Makassar KPU member Endang Sari confirmed that the lawsuit of eight former chairmen of the Voting Committee (PPS) in Tamalate District through his legal advisor was finally rejected by the Makassar State Administrative High Court (PTUN), South Sulawesi.

"The results of the Administrative Court's decision regarding the lawsuit against us from the Makassar KPU regarding the dismissal of eight PPS Tamalate people, are rejecting the plaintiffs' claim in its entirety," said Makassar KPU member Endang Sari as reported by ANTARA, Wednesday, November 29.

With this decision, said the Coordinator of the Voting Socialization and Education Division, Community Participation and Human Resources of the Makassar KPU, the plaintiffs would certainly not be conditional as organizers.

Based on the ptun-makassar.go.id e-court page with decision register number 65/G/2023/PTUN.MKS through the verdict reads the first trial, rejecting the plaintiff's claim entirely.

Second, punishing the plaintiffs to pay court fees of Rp273 thousand. The verdict was issued as of November 29, 2023.

Previously, the plaintiff's legal adviser Tri Sasro Amir filed a lawsuit with the Makassar Administrative Court regarding the alleged violation of procedures for the dismissal of eight PPS Chairpersons in Tamalate District by the Chairman and Member of the Makassar KPU on the basis of a decision from the Honorary Council of Election Organizers or DKPP.

In addition, his party even submitted an objection note to the Makassar KPU regarding the dismissal of his client who was considered a procedural defect, including reporting the right to the DKPP or dismissal of his client.

The objection note submitted to the Makassar KPU was a form of protest and at the same time a requirement to file a lawsuit at the Makassar Administrative Court after the DKPP decision was issued. This is because the commissioner's decision is an administrative act and should be tested.

The solution step can be taken through the first two ways, through the Makassar KPU itself by revoking its decision and rehabilitating dismissed PPS and reactivating the PPS status. Second, through a court decision.

DKPP in its decision letter number 108 -PKE-DKPP / VIII / 2023 decided to impose warning sanctions on four commissioners of the Makassar City KPU in the aftermath of the dismissal of eight PPS in Tamalate District.

The four Muh Faridl Wajdi as chairman, Endang Sari, M Gunawan Mashar and Abdul Rahman each member received warning sanctions for violating the organizing code of ethics related to the process of dismissing eight PPS not in accordance with the Indonesian KPU Decree number 337 of 2020 and several other KPU regulations.

The dismissal of the eight PPS after the Makassar KPU responded to the recommendation issued by the Makassar Bawaslu regarding the eight PPS heads in Tamalate District was proven to have met one of the legislative candidates and was deemed to have violated the rules and code of ethics of the organizers.
