JAKARTA - A total of 13 residents of Banyumas Regency, Central Java, filed a lawsuit against former Chief Justice of the Constitutional Court (MK) Anwar Usman at the Central Jakarta District Court (PN) as an effort to restore public trust in the Constitutional Court.
"Earlier at around 13.00 WIB, we registered a lawsuit against Anwar Usman at the Central Jakarta District Court," said the plaintiff's spokesman, Aan Rohaeni when contacted by reporters from Purwokerto, Banyumas Regency, Antara, Monday, November 13.
Aan said 13 Banyumas residents who filed the lawsuit consisted of five advocates, five students from the Faculty of Law, two candidates for advocates, and a writer.
They were accompanied by 18 attorneys who were members of the Alumni Advocate General Sudirman University (Unsoed) Purwokerto. In this case, his party wants to file a lawsuit because based on the decision of the Honorary Council of the Constitutional Court (MKMK) in a code of ethics Anwar Usman has been found guilty of committing a serious violation.
The compensation requested by the plaintiffs against Anwar Usman, he continued, was a total of Rp. 1,300,254,474,940.00, consisting of material compensation of Rp. 250,000,000.00 and total immaterial compensation of Rp. 1,300,004,474,940.00.
"In that context, what we actually filed a lawsuit was for Anwar Usman to resign. That's all the target," said he, who is also an advocate.
However, if the verdict does not resign, his party in the lawsuit also focuses on requesting the panel of judges at the Central Jakarta District Court so that Anwar Usman is declared to have committed a legal act. Furthermore, he said, Anwar Usman was proven guilty of a disgraceful act and also did not meet the requirements as a constitutional judge.
"That's our target because our target is single, the point is that we just want Anwar Usman to leave the Constitutional Court in order to maintain the muruah of the Constitutional Court as an institution that will soon become the only last fort to try the results of the election dispute," he said.
It was also emphasized that public trust in the Constitutional Court must be restored. If Anwar Usman remains a constitutional judge, it is believed that this will not change the public's perspective and trust in the Constitutional Court.
Therefore, he said, as the last institution or fort whose decision is final and binding for all, the Constitutional Court must be cleaned of the elements that have previously been proven to have committed serious violations.
"The serious violation means that he is constitutionally ineligible as a judge of the Constitutional Court," said Aan.
One of the plaintiff's attorneys, Edy Halomoan Gurning, said that the lawsuit filed by 13 Banyumas residents against Anwar Usman had been registered at the Central Jakarta District Court and was just waiting for the case number.
According to him, his party sees this effort as very strategic to accommodate the interests of the community represented by 13 Banyumas residents because there are concerns that the authority of the Constitutional Court will decrease after the Constitutional Court's decision.
"This is also one of the goals to re-uplift the authority of the Constitutional Court. We have discussed several strategies and efforts that we can take, hopefully we can do it as soon as possible," said Edy.
