Mahfud MD Hopes MKMK Gives The Best Decision For Healthy Democracy

JAKARTA - Coordinating Minister for Political, Legal and Security Affairs Mahfud MD hopes that the Honorary Council of the Constitutional Court (MKMK) can give the best decision. This is related to alleged violations of the code of ethics for democracy in Indonesia.

During a working visit at Universitas Brawijaya, Malang City, East Java, Saturday, Mahfud said that the decision to be read out by the MKMK is expected to be able to provide an overview of healthy democracy in Indonesia.

"I support Mr. Jimly (Chairman of MKMK), academics, constitutional lovers, and democracy to make the best of this for the existence of our healthy democracy," Mahfud said quoting Antara.

Mahfud explained that the Constitutional Court's decision is expected to be read out soon next week. No later than Tuesday (6/11). He hopes that the decision to be read out by the Constitutional Court will be the best decision,

Regarding the Constitutional Court's decision whether it will apply retroactively or not, Mahfud MD is still waiting for a decision. He did not want to express his opinion outside the court and before reading the verdict.

"Later, we will wait for Mr. Jimly first. We must not argue outside the court," he said.

Previously, MKMK Chairman Jimly Asshiddiqie stated that the Constitutional Court's decision regarding the alleged violation of the code of ethics of the nine judges of the Constitutional Court would have an impact on registering prospective presidential and vice presidential candidates.

The Constitutional Court's decision will be read out before the determination of the 2024 Presidential and Vice Presidential Election participants on November 13, 2023. The Constitutional Court stated that the Constitutional Court's decision regarding the minimum age requirement for vice presidential candidates must be escorted by the MKMK so that there is certainty.

MKMK has made a summons to Chief Justice of the Constitutional Court Anwar Usman regarding the alleged violation of the code of ethics as a constitutional judge. Anwar was examined regarding case decisions Number 90/PPU/XXI/2023 regarding the minimum age limit for presidential and vice presidential candidates.

Of the 21 reports of alleged violations of the constitutional judge code of ethics received by the Constitutional Court, ten of them were addressed to Anwar Usman. The MKMK will speed up the decision on the alleged violation of the code of ethics on November 7, 2023.
