The Defendant In The Case Of Accounting For Acute Kidney Failure In Kediri Was Sentenced To 2 Years In Prison, Lower Than The Demand

KEDIRI - The Kediri City District Court sentenced him to 2 years in prison and a fine of Rp. 1 billion, subsidiary to 3 months in prison for the defendant in the case of acute kidney failure. The judge's verdict is much lower than the demands of the public prosecutor who was sentenced to 9 years in prison.

Responding to this, the defendant's attorney, Yunus Adhi Prabowo, said that the 2-year criminal decision was lighter than the demands of the Public Prosecutor, namely 9 and 7-year sentences.

"The legal team still appreciates the judge's decision. However, we still believe that this case is a corporate crime because it was carried out by a pharmaceutical company in the form of a limited company (PT), not a personal client, so the defendant should be free," Yunus said in his statement, Thursday, November 2.

Furthermore, the advocate for the Central Board of the Indonesian Pharmacists Association (IAI) said that the defendants from PT AFI Farma Kediri still had 7 days to think about the next legal steps whether to appeal or not.

For this reason, his party will return the next step to the client for the appeal option.

"What is clear is that IAI continues to assist in every legal process carried out by IAI members, and also the Public Prosecutor also has the right to appeal," said Yunus.

It is known, at the trial of the decision on the case of acute kidney failure at the Kediri City District Court, Wednesday, November 1, which was attended by the four defendants, the defendant's legal advisory team, and the team of public prosecutors (JPU), the judge read out the verdicts for the defendants.

The judge assessed that the four defendants were legally and convincingly guilty of committing a criminal act by intentionally producing pharmaceutical goods that did not meet the standards and security factors as stated in Article 196 in conjunction with Article 98 paragraphs 2 and 3 of Law no. 36 of 2009 concerning health.

In this decision, the judge's verdict was lower than the demands of the Public Prosecutor (JPU). As is known in his claim, the Public Prosecutor (JPU) requested that the defendant Arif Prasetya Harahap (President Director of PT AFI Farma) be sentenced to 9 years in prison and a fine of 1 billion rupiah.

Meanwhile, Nony Satya Anugrah (Manager Quality Control), Aynarwati Suwito (Manager Quality Insurance), and Istikhomah (Manager Production) were each sentenced to 7 years in prison.

However, in the verdict read out by Judge Boedi Haryantho (Chairman), Agung Kusumo Nugroho, and Ira Rosalin (members) at the Kediri City District Court (PN) alternately, the defendants were sentenced to 2 years in prison and a fine of Rp. 1 billion, subsidiary to 3 months in prison.
