"So, there are no more problems with HGB above the HPL. The initial owner of PT Indobuildco no longer has the right to the land," he explained.
Hadi also explained the chronology of the management of the Sultan Hotel land covering an area of approximately 13 hectares which is disputed at this time.
Initially, the management of land from HGB ownership issued in 1973 agreed to be managed by Indobuildco with a period of 30 years until 2022. Then, in 1989 in the midst of this management period, the government through the Ministry of ATR/BPN issued a Certipikat HPL 1/Gelora for the entire GBK area.
"PT Indobuildco sees that HPL Number 1 of 1989 in the Senayan area becomes legally on behalf of the State Secretariat," he said.
Before the end of management in 2022, PT Indobuildco had also applied for an extension of the HGB in 1999. However, at that time, the extension period was rejected.
"The year 1999 was rejected, but in 2002, a 20-year extension permit was issued. So (from the year of extension) 2002 plus 20 years, the end of 2022," explained Hadi.
As for now, the government has won a lawsuit in court regarding the ownership of the disputed land. PT Indobuildco lost even though he had filed a civil lawsuit with the court until the judicial review (PK) was four times.
In fact, the company has again filed a lawsuit with the State Administrative Court (PTUN) this year.
