Ministry Of ATR/BPN Welcomes Administrative Court Decision On Block 15 Dispute GBK

JAKARTA - The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) welcomed the decision of the Jakarta State Administrative Court (PTUN) on the block dispute of 15 Gelora Bung Karno.

"On behalf of the Ministry of ATR/BPN, we would like to thank the panel of judges who have tried the case and in the end stated that the issuance of a decision letter granting management rights on behalf of the State Secretariat and its attachment was declared to have complied with applicable procedures," Tedjo said as quoted by ANTARA, Monday, August 28.

He hopes that with this decision, the government can optimize the GBK area better.

To note, the Building Use Rights (HGB) for the GBK area of HGB Number 26/Gelora and HGB Number 27/Gelora were previously on behalf of PT Indobuildco. However, that right expires on March 3, 2023 and April 3, 2023.

With the end of the HGB, the existing land parcels are part of the management rights on behalf of the Ministry of Finance cq of the Gelora Bung Karno Complex Management Center (PPKGBK).

Tedjo said PT Indobuildco filed a lawsuit related to the decision letter granting the registered Land Management Rights (HPL), namely the Decree of the Head of BPN Number 169/HPL/VAT dated August 15 of 1989 concerning the granting of management rights on behalf of the Indonesian State Secretary and the Sports Center Management Agency Senayan and attachment on August 15, 1989. In the appendix there are serial numbers 26 which 27 states that HGB number 26 and number 27 gelora on behalf of PT Indobuildco is part of the HPL.

"This is what became the object of the lawsuit because PT Indobuildco felt that HGB's revenue numbers 26 and 27 were considered not procedural. Alhamdulillah, this afternoon the panel of judges has examined and then tried and finally decided the case," he explained.

The attorney for the Center for the Management of the Bung Karno Gelora Complex (PPKGBK) Saor Siagian legally emphasized that PT Indobuildco has no longer had the right to make efforts or actions at that place since March and April 2023.

"Therefore, we ask that what has been ordered by the court to immediately return it to the GBK manager to be followed up immediately. We remind that there are logical consequences if there are still people who are not entitled to take action and even make business efforts there, there is a legal threat," said Saor.

Previously reported, as a follow-up to the Ministry of State Secretariat cq PPKGBK, it will revitalize the GBK area, including through infrastructure improvement, regional arrangement, additional parking areas and accessibility, provision of supporting facilities, as well as urban forest arrangement and green open spaces (RTH).
