Case Of Fake KTP, Ukrainian Citizen Sentenced To 1 Year 8 Months In Prison At Denpasar District Court

DENPASAR - A judge at the Denpasar Corruption Court, Bali, handed down a different verdict to two foreign nationals from Syria and Ukraine in the bribery case for making identity cards, family cards and birth certificates.

In his ruling, Chief Judge Agus Akhyudi sentenced a Syrian citizen named Mohammad Nizar Zghaib (32) to two years in prison.

Meanwhile, Ukrainian citizen Krynin Rodion (39) was sentenced to 1 year and 8 months in prison.

"The sentence against Mohammad Nizar Zghaib alias Agung Nizar Santoso is two years in prison," said Judge Agus as quoted by ANTARA, Wednesday, August 9.

The sentences were lower than the demands of Public Prosecutor Mia Fida Erliyah, Catur Riyanita and I Ketut Kartika Widyana in a trial on July 20, 2023, Mohamad Nizar were each sentenced to three years in prison and Krynin Ridion for two years and six months in prison.

In addition to being sentenced to imprisonment, both of them were sentenced to pay a fine of Rp. 50 million, subsidiary to one month in prison.

The panel of judges assessed that the two foreigners were legally and convincingly proven to have bribed the state apparatus in order to obtain a false identity of an Indonesian national.

The two defendants were deemed not to have managed their ID cards, family cards and birth certificates as regulated by the Indonesian government.

Nizar and Rodion's actions were proven to have violated Article 5 paragraph 1 letter a of Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption in conjunction with Article 55 Paragraph 1 of the Criminal Code.

The judge explained that the two foreigners together with a spa employee named Nur Kasinayati Marsudiono and members of Denma Kodam IX/Udayana Patari Nur Pujud (files at the Denpasar Military Court) bribed I Wayan Sunaryo and I Ketut Sudana.

In this case, the judge sentenced Nur Kasinayati and I Wayan Sunaryo to one year in prison.

Meanwhile, I Ketut Sudanadi was sentenced to one year in prison in court on July 26, 202.

In the indictment read out on May 20, 2023, the Public Prosecutor's Office of Denpasar outlined the two defendants as those who participated in committing acts, namely giving or promising something to civil servants or state officials to make something in their positions that was contrary to their obligations.

They both bribed the Head of Sekar Kangin Hamlet Wayan Sunaryo and honorary employees of South Denpasar District I Ketut Sudana.
