Kejari Samarinda Process 3 Cases Restorative Justice

The Samarinda District Attorney's Office (Kejari) has processed three cases, each of which is restorative justice.

Head of the Intelligence Section of the Samarinda District Attorney's Office Erfandy Rusdy Quiliem said the decision was after his party facilitated a meeting between the suspect and the victim and related parties.

"To get peace on these three cases (cases) was carried out by the Public Prosecutor (JPU) of the Samarinda District Attorney on different days," he said in Samarinda, East Kalimantan (Kaltim), Friday, August 4, which was confiscated by Antara.

After facilitating both parties to agree to take a peaceful path, his next process submitted a request for termination of prosecution based on restorative justice to the Deputy Attorney General for General Crimes.

He detailed that the facilitated case is now awaiting approval of the restorative justice process, after a meeting was held on Thursday, August 3, 2023, at the Restorative Justice House of the Class II A Rutan Samarinda.

The Public Prosecutor of the Samarinda Prosecutor's Office, Fajarudin Semar Thaimiyah Salampessy, has facilitated peace with the suspect with the initials KP and the victim on behalf of Intan Ariani for the first step in carrying out restorative justice in cases of persecution.

During the meeting, the suspect apologized directly to the victim and promised not to repeat his actions, then the victim forgiven and was willing to settle the case through restorative justice or without going through the court.

The second case is a traffic and road transportation case between suspect MY and victim Kholid, namely due to the negligence of the suspect on the highway, causing accidents and harming others.

In this case, the Public Prosecutor's Office of Samarinda Agus Purwantoro on Wednesday, August 2, facilitated peace between MY and Kholid for the first step in carrying out restorative justice, as stipulated in the Indonesian Prosecutor's Regulation Number 15/2020 concerning termination of prosecution based on restorative justice.

During the meeting, the suspect apologized directly to the victim and the victim apologized, and was even willing to resolve this case through restorative justice.

The third case is about the collection of goods carried out by the suspect ZI with the victim Indri, so that on Monday, July 31, 2023, the Public Prosecutor's Office of Samarinda Agus Purwantoro facilitated peace and the two parties agreed to peace through restorative justice.

"The results of the mediation, the victim and the suspect agreed to make peace which was witnessed by community leaders and families from both parties. Furthermore, the Samarinda Kejari submitted an expos on the request to stop the prosecution based on restorative justice to the Deputy Attorney General for General Crimes," said Erfandy.
