Corruption Convicts For The Tanjabbarat Jambi Public Works Project Return State Losses Of IDR 2.5 Billion

JAMBI - Adrianus Utama Suwandi was convicted of a corruption case at the Tanjung Jabung Barat District Public Works Office (Tanjabbarat) Jambi Province to return the state loss money worth IDR 2.5 billion.

Head of the Tanjung Jabung Barat High Prosecutor's Office (Kajari) Marcelo Bellah said the return had been received by his party.

As for the details, the replacement money (UP) was Rp. 1.87 billion, a fine of Rp. 300 million and evidence of Rp. 390 million came from other convicts who handed over the money to the Prosecutor's Office to be returned to the state.

"The total state money returned by the convict Adrianus is all Rp. 2.5 billion and we will hand it over this afternoon to the State Treasury through banks," he said in Jambi, Thursday, July 20, which was confiscated by Antara.

In the corruption case of the construction of clean water facilities project at the Tanjabbarat Regency Public Works Office for the 2014 fiscal year, Adrianus Utama Suwandi and three other convicts have permanent legal force.

The other three convicts are David Sihombing, Fatmayanti and Yalmaswara.

The judge sentenced the convict David Sihombing as the Commitment Making Officer (PPK) and Fatmayanti Director of PT Multi Karya Interplan Consultant each with a prison sentence of 1 year and 6 months.

The two defendants were also charged with paying a fine of Rp. 50 million each, a subsidiary of two months.

Meanwhile, the convict Yalmaswara as the executor of the project work was sentenced to 2 years and 6 months in prison and a fine of Rp. 100 million, subsidiary to three months in prison. Yalmaswara was also charged with paying compensation of Rp. 550 million.

At that time, the panel of judges said that if it was not paid one month after the decision had permanent legal force, then the property was confiscated and auctioned off. If it is not sufficient, it will be replaced with 8 months in prison.

The defendant's actions as threatened by the subsidiary indictment violated Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code.

Meanwhile, the convict Ardianus Utama filed an appeal. In the cassation decision, the judge sentenced Ardianus Utama to 6 years in prison and a fine of Rp. 300 million provided that if the fine is not paid, it will be replaced with imprisonment for six months.

Ardianus Utama was also sentenced to pay a replacement money of Rp1.8 billion by taking into account the money deposited with the Public Prosecutor amounting to Rp1.9 billion so that the excess money deposited of Rp45 million was returned to the defendant.
