Indictment: Inactive Bandung Walkot Yana Mulyana Bribed Rp881 Million To Smooth CCTV And ISP Projects

The prosecutor from the Corruption Eradication Commission (KPK) charged three defendants of giving bribes to the inactive Bandung Mayor Yana Mulyana to give a total of Rp. 888,221,000. This money was given to smooth out the CCTV and Internet Service Provider (ISP) camera procurement project in the Bandung Smart City program by the Bandung City Government. KPK Public Prosecutor Tito Jaelani said the three defendants were Sony Setiadi as President Director of PT Citra Jelajah Informatika (PT Cifo), Benny as Director of PT Sarana Mitra Adiguna (PT SMA), and Andreas Guntoro as Manager of PT SMA. "Doing some acts, although each is a crime or a violation, there is such a relationship that it must be seen as a continuing act, giving or promising something, namely giving money," Tito said in a hearing at the Bandung District Court, Bandung City, West Java, Antara, Wednesday, July 5. The prosecutor explained that Sony was charged with giving bribes of Rp. 186 million to Yana and Khairur Rijal as the Head of Traffic and Road Equipment for the Bandung City Transportation Service. Meanwhile, Benny and Andreas were charged with disbursing money amounting to Rp. 702,221,000 to bribe Rijal, Yana, to the cost of a number of Bandung City Government officials traveling to Thailand. In the case of ISP procurement, the prosecutor said that Sony gave Rp. 100 million to Yana with the intention that his company would be elected. After being elected, PT Cifo also received a payment of Rp. 565 million, then Sony gave a bribe to Rijal of Rp. 86 million. As for the CCTV procurement case, PT SMA was initially approved to carry out four work packages consisting of CCTV procurement and CCTV maintenance with a project value of Rp774,712,250. From that work, Yana was then interested in holding CCTV on a larger scale based on the Bandung Smart City program. Then the Head of the Transportation Service Dadang Darmawan and Rijal also designed the CCTV procurement with a value of Rp. 5 billion. Then the defendants also invited Rijal, including Dadang and Yana, to see the procurement of finished CCTV with the same brand installed in Bangkok, Thailand. The defendants then poured Rp321,401,000 in cash for a tour to Bangkok, Rp7,200,000 to rent a waiting room at Soekarno-Hatta Airport, Rp1,293,000 for food costs while in Thailand, and Rp7,327,000 to buy Yana Louis Vuitton (LV) shoes. "Yana Mulyana is satisfied and wants to continue using the Huawei Smart Camera CCTV brand which is used in procurement, which the specifications are owned by the defendant's company," said Tito.

For their actions, the defendants were charged with Article 5 paragraph (1) letter a and Article 13 of the Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 64 paragraph (1) of the Criminal Code. As for the charges of Benny and Andreas, the prosecutor also charged Article 55 paragraph (1) of the 1st Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code because of the actions that were carried out together.
