The Prosecutor's Office executed Nugroho, convicted of corruption in the structuring and dredging project of the Labuhan Haji Pier in East Lombok to the Selong Correctional Institution (Lapas).

Head of the Intelligence Section of the East Lombok District Attorney (Kejari), Lalu Mohamad Rasyidi, said that the execution of the convict Nugroho was in accordance with the decision of the Supreme Court of the Republic of Indonesia Cassation Number: 1244 K/Pid.sus/2023.

"So, this afternoon we carried out the execution of the Supreme Court's decision by directly delivering the person concerned to serve his sentence at the Selong Prison," said Rasyidi by telephone, Thursday, June 8, which was confiscated by Antara. With the execution of the detention, Nugroho, who plays the official commitment maker (PPK) of the project in the corruption case, has now officially become a convict.

The cassation judge tried himself by imposing a sentence of three years in prison and a fine of Rp. 200 million, subsidiary to three months in prison to Nugroho.

The judge also ordered Bank BNI Main Branch Bandung as the underwriter for the 2016 project down payment to disburse project down payment guarantees worth Rp6.7 billion and submit it to the East Lombok regional treasury.

The down payment guarantee is in accordance with the disbursement of 20 percent of the project budget which is considered by the judge to be compensation for state losses.

The judge set such a sentence by declaring Nugroho not proven guilty in the primary indictment of the public prosecutor, but rather proven to be in accordance with the subsidiary charges.

The indictment relates to Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.

Dengan menyatakan demikian, hakim menetapkan masa penahan yang telah dijalani oleh terdakwa, dikurangi sepenuhnya dari pidana yang dijatukan. Hakim pun menetapkan agar terdakwa menjalani penahanan.

From the first instance court decision which declared Nugroho free from all prosecutors' demands, there was an order from the judge that all evidence be returned to the prosecutor to be used in the case of the suspect with the initials TR, who is now a fugitive from the prosecutor.

The judge in his decision believes that PT Guna Karya Nusantara (GKN) belonging to TR as the project implementer who received the down payment stated that he was responsible for the emergence of state losses.

Regarding the handling of the TR case, Rasyidi said that his party is still searching in the field. "Yes, the TR suspect is still being sought, he is still at large," he said.
