Officially Appeal Decision Postponement Of The 2024 Election, KPU: A Form Of Seriousness In Facing The Prima Party Lawsuit

The General Election Commission (KPU) of the Republic of Indonesia has officially filed an appeal against the decision of the Central Jakarta District Court (PN Jakpus) which ordered the KPU to stop the 2024 General Election stage. This appeal refers to the case of the People's Fair and Prosperous Party (Prima) lawsuit which was declared not to have passed the administrative verification stage by the KPU. The Prima Party's lawsuit won at the Central Jakarta District Court. RI KPU member Mochammad Afifuddin emphasized that this appeal memorandum submission is the KPU's seriousness in addressing legal issues with Prima. As is known, the KPU was also reported to the Honorary Council for Election Implementation (DKPP) by KAMMI because it was considered to underestimate Prima's lawsuit at the Central Jakarta District Court. "The Banding statement made by the KPU on the Decision of the Central Jakarta District Court Number 757/Pdt.G/2022/PN.Jkt.Pst is a form of the KPU's seriousness in dealing with and responding to the lawsuit filed by Prima," Afif told reporters, Friday, March 10. Currently, Afif continued, the KPU is waiting for a decision from the Jakarta High Court Judge against the appeal submitted. Prior to that, RI KPU member Idham Kholik considered that Prima's election civil lawsuit to the Central Jakarta District Court had been wrong from the start. He emphasized that the decision issued by the KPU related to the stages of the election, especially with the stipulation of political parties participating in the election, was an object of dispute that was only processed in the Election Supervisory Body (Bawaslu) and the State Administrative Court (PTUN). "The process is in the Administrative Court because this is civil, categorized as civil. So that the election law places the dispute in the process in the Administrative Court, apart from Bawaslu," Idham told reporters, Thursday, March 3. Moreover, continued Idham, there is no term postponement of elections due to civil disputes in court in Law Number 17 of 2017 concerning General Elections. "In the election law, there are two terms, there are further elections and follow-up elections," he said. Initially, the Prima Party sued the KPU to the Central Jakarta District Court because it felt aggrieved by the election organizers. This is because the KPU stated that the Prima Party did not meet the requirements in undergoing registration and verification of political parties that would participate in the 2024 General Election. As a result, the Prima Party could not continue the election stages to factual verification. The Prima Party did not accept it. In their study, Prima said that the KPU was not careful in carrying out administrative verification. Prima also views the Political Party Information System (Sipol) as problematic and causes the party to fail in the administrative verification stage. Prima's civil lawsuit to the Central Jakarta District Court with the defendant, namely the Indonesian KPU, was filed on December 8. Central Jakarta District Court's decision came out with case number 757/Pdt.G/2022/PN Jkt.Pst on Thursday, March 2. The panel of judges granted the Prima Party's lawsuit against the KPU not to carry out the remaining stages of the 2024 General Election and carry out the election stages from the start for approximately 2 years. In their consideration, the panel of judges ordered the KPU not to continue the remaining stages of the 2024 General Election in order to restore and create a fair situation and protect so that as early as possible other incidents due to mistakes, inaccuracies, inaccuracies, unprofessionalism, unprofessionalism, and injustice committed by the KPU as the defendant. In addition, the panel of judges also stated that legal facts had proven that there was a condition of error in the Political Party Information System (Sipol) caused by the quality factor of the tools used or factors outside the infrastructure. This happened when the Prima Party had difficulty conveying the improvement of data on political party participants into Sipol who had an error in the system. Without tolerance for what happened, the KPU determined that the status of the Prima Party did not meet the requirements (TMS) as a political party participating in the 2024 General Election.
