In Front Of Constitutional Judge, Legal Counsel Confirms That Yuwono Pintadi, Who Is Suing The Election System, Is Not A NasDem Cadre

JAKARTA - The attorney for the related party from the NasDem Party Risky Dewi Ambarwati emphasized that the applicant on behalf of Yuwono Pintadi in case Number 114/PUU-XX/2022 related to the closed proportional General Election (Election) system is not a cadre of the party.

"Brother Yuwono Pintadi is not a member or cadre of the NasDem Party," said the attorney for the related party from the NasDem Party, Risky Dewi Ambarwati, in a hearing on case No. 114/PUU-XX/2022 regarding the closed proportional election system held by the Constitutional Court in Jakarta, Thursday, February 16th.

This assertion was conveyed by Risky because the applicant used the attributes and identity of the NasDem Party as an applicant at the Constitutional Court, in challenging Law Number 7 of 2017 concerning General Elections.

On that basis, the related parties feel that there is a causal relationship with the a quo petition filed.

Moreover, one of the applicants on behalf of the NasDem Party. Meanwhile, related parties reject the closed proportional electoral system and assess the open proportional as an ideal practice in democracy.

In front of a panel of constitutional judges chaired by Anwar Usman, Risky emphasized that the applicant was not registered at all in the membership system of the NasDem Party.

"Yuwono Pintadi's actions and legal actions in no way represent the position of the NasDem Party in proposing the PUU a quo," she reiterated.

Application Number 114/PUU-XX/2022 regarding the review of the Election Law was filed by Demas Brian Wicaksono, Yuwono Pintadi, Fahrurrozi, Ibnu Rachman Jaya, Riyanto, and Nono Marijono.

The petitioners argue that Article 168 Paragraph (2), Article 342 Paragraph (2), Article 353 Paragraph (1) letter b, Article 386 Paragraph (2) letter b, Article 420 letters c and d, Article 422, Article 424 Paragraph ( 2), Article 426 Paragraph (3) contradicts the 1945 Constitution of the Republic of Indonesia.

The petitioners argued that the enactment of the norms of the article relating to the proportional election system based on the most votes, has significantly hijacked pragmatic legislative candidates who only capitalize on popularity without any ideological ties and political party structures.

As well as having no experience in managing political party organizations or socio-political-based organizations. As a result, when elected as a member of the DPR/DPRD it is as if they are not representing a political party organization but representing themselves.
