Denying The New Criminal Code Applicable To Ferdy Sambo, Mahfud MD: The Death Toll Becomes A Prison For Life Must Be In The Reading Of Judge Sentences

Coordinating Minister for Political, Legal and Security Affairs Mahfud MD straightened out the narrative in a video on social media regarding the death penalty sentence handed down to Ferdy Sambo in the premeditated murder case of Brigadier J.

In the video, was shown by Deputy Minister of Law and Human Rights Edward Omar Sharif Hiariej that the rules for the death penalty in the Criminal Code (KUHP) only began with a probationary period of 10 years and could be changed if the convict behaved well. Mahfud MD also denied that this was true for Sambo.

"This is like slander against the Minister of Home Affairs and the Deputy Minister of Law and Human Rights. In fact, the draft content of the RKUHP that the death penalty can be changed for life was agreed upon years before the Sambo case," Mahfud wrote on his Twitter account @mohmahfudmd, Thursday 16 February.

Mahfud continued, the new Criminal Code still needs a transition and is only valid for 3 years. In the Criminal Code which was ratified by President Jokowi in early 2023, criminal penalties also apply if the judge mentions it in the verdict.

"Besides, the RKUHP has only been in effect for 3 years. And according to the RKUHP, changes to the sentence must be in the judge's verdict. There is no verdict," he said.

The panel of judges sentenced the former Head of the Propam Division at the National Police Headquarters Ferdy Sambo to death in a verdict hearing that took place at the South Jakarta District Court, Monday, February 13. Sambo was found guilty in the premeditated murder case of Brigadier J.

In its decision, the panel of judges believes that Ferdy Sambo has violated Article 340 of the Criminal Code in conjunction with Article 55 Paragraph 1 to (1) of the Criminal Code.

"The defendant Ferdy Sambo has been legally and convincingly proven guilty of committing a criminal act, participating in premeditated murder... together," said Chief Judge Wahyu Iman Santosa in a trial reading Ferdy Sambo's decision.

The panel of judges considered the aggravating matter, namely Ferdy Sambo, was considered complicated when giving testimony.
