Lower Than The Prosecutor's Claims, Former Lin Che Wei's Assistance Team Was Sentenced To A Year In Prison For The Corruption Case Of Cooking Oil

JAKARTA - Former member of the Assistant Team for the Coordinating Minister for Economic Affairs Weibinanto Halimdjati alias Lin Che Wei was sentenced to one year in prison in a corruption case in the approval of exports of crude palm oil and its derivatives, including cooking oil. "The defendant Weibinanto Halimdjati alias Lin Che Wei was sentenced to one year in prison and imposed a fine of Rp. 100 million, subsidiary to 2 months in prison," said Chief Justice Liiek Prisbawono Adi during a trial at the Corruption Court (Tipikor), Jakarta, Antara, Wednesday, January 4. The panel of judges assessed that Lin Che Wei, who is also a policy/analytic advisor at the Independent Research & Advisory Indonesia (IRAI), was proven to have committed a criminal act of corruption based on the subsidiary indictment of the public prosecutor, namely from Article 3 in conjunction with Article 18 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code. This verdict is much lower than the demands of the Public Prosecutor of the Attorney General's Office. Lin Che Wei was charged with imprisonment for eight years and imposed a fine of Rp. 1 billion which if not paid was replaced with imprisonment for six months. The claim is based on the primary indictment of Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code. However, the panel of judges assessed that Lin Che Wei was not found guilty of the primary charge so that he was only sentenced to one year in prison and a fine of Rp. 100 million. In drafting the decision, the panel of judges considered burdensome and mitigating matters. Related to aggravating matters, among others, the panel of judges assessed that the defendant's actions did not support the government's program related to eradicating corruption. Meanwhile, the mitigating thing is that Lin Che Wei has never been convicted, committed his actions to help the government overcome the scarcity of cooking oil, did not accept honorariums, and was polite in the trial. On this decision, Lin Che Wei and the team of attorneys and public prosecutors stated that they would think about it for seven days in filing an appeal.
