JAKARTA - The North Penajam Paser District Attorney (Kejari) received an delegation of illegal or permit mining case files carried out in the State Capital area of the East Kalimantan High Prosecutor's Office (Kajati). Head of the North Penajam Paser Kejari, Agus Chandra in Penajam explained, unlicensed mining was discovered since September 17, 2022. Prosecutors then conducted an investigation on September 23, 2022. During the mining without such permits operating, it resulted in approximately 500 MT (metric tons) of coal. Mining without permission violates Article 35 of Law Number 3 of 2020, concerning Amendments to Law Number 4 of 2009 concerning Mining, Mineral, and Coal. Perpetrators or suspects who carried out mining activities without permits, he explained, were threatened with a maximum imprisonment of five years, and a maximum fine of Rp. 100 billion. Mining evidence without permits was temporarily secured at the Sepaku Sector Police (Polsek), due to distance constraints if it was secured at the North Penajam Paser Prosecutor's Office. Evidence secured from such permitless mining activities was in the form of Caterpilar 320 D excavators, as well as 152 MT of coal, reported from Antara, Monday, November 21.

The mining case without a permit has been transferred by the East Kalimantan Prosecutor's Office to the North Penajam Paser Prosecutor's Office. "We received the illegal mining case file from the East Kalimantan Prosecutor's Office, which has entered phase two," said Agus Chandra. The prosecution was handed over to the Public Prosecutor (Jaksa public prosecutor) of the North Penajam Paser Kejari after it was declared complete because the location of the case was in North Penajam Paser Regency. Unlicensed mining was carried out in the IKN Nusantara area, namely in the Gunung Basin area RT 01 Sukomulyo Village, Sepaku District, North Penajam Paser Regency.
