The Attorney General's Office has prepared state attorneys to assist the Food and Drug Administration (BPOM) in dealing with a lawsuit related to a sirop drug case that triggers acute kidney failure in children at the Jakarta State Administrative Court (PTUN).
The effort to prepare the state attorney (JPN) was discussed in a meeting between Attorney General Sanitiar Burhanuddin and Head of BPOM Penny Kusumastuti Lukito which took place behind closed doors at the Kartika Adhyaksa Tower, the Indonesian Attorney General's Office, Jakarta, Wednesday, November 16.
"It is the obligation of JPN to assist the government, in this case BPOM," said Burhanuddin, quoted in a written statement from the Attorney General's Office for Legal Information, Antara, Wednesday night.
During the meeting, the Head of BPOM submitted a request for support to the Attorney General's Office regarding law enforcement regarding the handling of cases of illegal drug trafficking which resulted in acute kidney disease in children.
Receiving an audience with the Head of BPOM, the Attorney General was enthusiastic and welcomed this as a law enforcement obligation, especially regarding Indonesian children who were exposed to acute kidney failure.
"We are very supportive for the quick and even if possible, in the future, the process of handling the case is not only related to criminal acts, but also carried out with civil lawsuits," he said.
This step is taken so that companies that commit violations get a deterrent effect by paying compensation to the state and society as victims.
"So, companies related to the case can pay compensation to the state and also the people who are victims," said Burhanuddin.
The next thing discussed in the meeting was the strengthening of BPOM institutions, which so far wanted laws related to the supervision of drugs and food and control carried out by BPOM.
Regarding this, the Attorney General suggested that legal drafting be immediately consulted with the Deputy Attorney General for Civil and State Administration so that the process could be accelerated and laws and regulations would likely be made to anticipate and accommodate problems that are developing in the community.
In addition, the Head of BPOM Penny Lukito also hopes that the process of handling illegal drug cases will be accelerated so that it will get legal certainty for the perpetrators and victims.
Regarding this, the Head of the Legal Information Center of the Attorney General's Office, Ketut Sumedana, said that the Deputy Attorney General for General Crimes (Jampidum) had received three Investigation Commencement Orders (SPDP) related to cases of illegal drug trafficking, namely two SPDPs from BPOM and one SPDP from the National Police Headquarters, and will develop again the SPDP in question, but the suspect has not yet been determined.
Previously, BPOM was sued by the Indonesian Consumer Community to the Administrative Court regarding the sirop drug case. The lawsuit has been registered at the Jakarta Administrative Court on November 11, 2022 with case number 400/G/TF/2022/PTUN.JKT.
