DENPASAR - Immigration deported a Malaysian citizen with the initials HKS (49) after he served 10 years in prison at the Kerobokan Penitentiary, Badung, Bali, as a convict shabu-shabu courier.

Head of the Regional Office of the Ministry of Law and Human Rights of Bali Province, Anggiat Napitupulu, explained that HKS was deported because he violated Article 75 paragraph (1) of Law No. 6/2011 on Immigration in conjunction with Article 113 paragraph (2) of Law No. 35/2009 on Narcotics.

HKS was arrested by Customs officers at the Arrival Terminal of I Gusti Ngurah Rai International Airport on March 19, 2012 because he smuggled 169 grams of crystal methamphetamine hidden in the cavity of his suitcase.

He brought the methamphetamine into Indonesia from Thailand using a visa-free facility on an Air Asia flight number FD 3677.

HKS, known as Hew Kok Seong, admitted to working as a construction worker in Kuala Lumpur. He got an offer to work in Indonesia for one year for 100 US dollars per day from someone he met in Malaysia.

He accepted the offer and flew to Indonesia via Thailand with a suitcase filled with shabu-shabu. He was later arrested by the police and put on trial. The Denpasar District Court then sentenced HKS to 13 years in prison, two years less than the prosecutor's demand.

"According to the decision of the Denpasar District Court Number 480/Pid.B/2012/PN DPS on August 6, 2012 and he was sentenced to 13 years in prison and a fine of Rp. 10 billion, subsidiary to three months in prison," Anggiat said.

HKS also served his sentence as a narcotics convict at the Kerobokan Prison and received various remissions. After languishing in prison for approximately 10 years, he was declared free as stated in the Release Letter Number W20.PAS.EDP.PK.01.02-129 dated July 6, 2022.

LP Kerobokan handed over HKS to the Immigration Office of Class I Special TPI Ngurah Rai regarding further administrative sanctions. However, HKS could not be deported immediately because his passport expired, so he was detained at the Denpasar Immigration Detention Center since 22 July 2022.

The head of the Denpasar Immigration Detention Center, Babay Baenullah, in the same written broadcast, explained that HKS had been languishing in his place for 15 days. He was finally deported on Friday (5/8) after Immigration in Malaysia issued a temporary travel document in lieu of a passport.

Two Immigration officers in Denpasar accompanied the deportation of HKS from I Gusti Ngurah Rai International Airport using Malindo Air to Kuala Lumpur with flight number OD305.

The Head of the Regional Office of the Ministry of Law and Human Rights in Bali said that currently HKS has been reported to be included in the deterrence list so that if it is approved by the Directorate General of Immigration, it cannot enter Indonesian territory.

He explained that Article 99 in conjunction with Article 102 paragraph (3) of Law Number 6/2011 concerning Immigration regulates that foreigners who are considered to be able to disrupt security and public order can be prevented from entering Indonesian territory for life.

"Further deterrence decisions are made by the Directorate General of Immigration by looking at and considering all cases," said Anggiat.
