Overstay For 866 Days, Siblings From Morocco Deported From Bali

BADUNG - Bali immigration officers deported two women Foreign Citizens (WNA) from Morocco with the initials ZO (37) and MO (41). The two foreign brothers and sisters were deported for overstay for 866 days in Indonesia.

Head of the Regional Office of the Ministry of Law and Human Rights (Kemenkum HAM) Bali, Anggiat Napitupulu said the two women were deported in accordance with Article 78 paragraph 3 of Law Number 6 of 2011 concerning immigration. They violated the residence permit because they exceeded the visa deadline, aka overstay.

"Foreigners who hold a residence permit whose validity period has expired and are still in the territory of Indonesia for more than 60 days from the deadline for a residence permit are subject to immigration administrative measures in the form of deportation and deterrence," said Anggiat, Tuesday, August 2.

This foreigner from Morocco arrived at Soekarno-Hatta Airport on November 27, 2019 for a vacation. Both use a Visit Visa Free (BVK).

Meanwhile, the BVK is only valid for 30 days. But these two foreigners did not return to Morocco because of the pandemic.

"The person concerned did not leave the territory of Indonesia. Both admitted that they did not return to Morocco because according to information from their mother that the international flights there had been closed due to the COVID-19 pandemic," said Anggiat.

They then chose to stay in Indonesia by relying on money sent by their parents. The two Moroccan women also did not know about the onshore extension rules at the immigration office for residence permits. For their negligence, they were declared overstayed.

"Although he argues that this is due to negligence, immigration can still carry out immigration administrative actions that are in line with the principle of ignorance of the law not justifying anyone," said Anggiat.

However, because the deportations could not be carried out and the travel documents for the two women expired, they were both entrusted to the Denpasar immigration detention center (Rudenim).

After being detained for 71 days, the two Moroccan citizens were deported from Bali. Both boarded Saudia Airlines from Soekarno-Hatta Airport.

"After we report the deportation, the decision on further deterrence will be decided by the Directorate General of Immigration by looking at and considering all the cases," said Anggiat.
